HomeMy WebLinkAbout07723ORDINANCE NO. 7723 AN ORDINANCE AMENDING SECTION 6 OF CHAPTER 8 OF TITLE VI OF THE PUEBLO MUNICIPAL CODE RELATING TO THE ELIGIBLE LIST FOR ENTRY LEVEL FIREFIGHTERS WHEREAS, the City Manager, Fire Chief and Acting Human Resources Director recommend that the following modification to the certification of names on the entry level firefighter list will best meet the demands of the Fire Department and the City, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: (brackets indicate matter deleted, underscoring indicates matter added) SECTION 1 Paragraph a of Subsection (6), Section 6, Chapter 8 of Title VI of the Pueblo Municipal Code is amended to read as follows: The Director shall forward a copy of the appropriate class specification to the Civil Service Commission, with a request for certification of the names of the five (5) highest- ranking persons on the appropriate eligible list, except for administrative assistant which will be a request for the certification of the name of the fifteen (15) highest ranking persons on the eligible list, and except for entry level firefighters which will be a request for the certification of the names of the twenty (20) highest - ranking persons on the eligible list. SECTION 2 Paragraph a of Subsection (6), Section 6, Chapter 8 of Title VI of the Pueblo Municipal Code is amended to read as follows: If less than five (5) names appear on the eligible list, or fifteen (15) names on the administrative assistant eligible list, or twenty (20) names on the entry level firefighter eligible list the City Manager may either request that the Commission establish a new eligible list, or may accept a certification of less that five (5) names, or fifteen (15) names in the case of administrative assistant, or twenty (20) names in the case of entry level firefighter. SECTION 3 Subsection (8) of Section 6 of Chapter 8 of Title VI of the Pueblo Municipal Code is amended to read as follows: Notwithstanding any provision of Subsection (6) above, any vacancy in a position in a class included in the other classified employees bargaining unit which is not filled by one (1) of the methods set out in Subsections (1) through (4) above shall be subject to the Rule of Three procedure set out in Subsection (5) above rather than the Rule of Five or Rule of Fifteen or Rule of Twenty procedures set out in Subsection (6) above, unless otherwise provided in the collective bargaining agreement covering the other classified employees. SECTION 4 This Ordinance shall become effective immediately upon final passage and approval and shall be automatically repealed effective January 1, 2011 and such repeal shall reinstate the sections of the Pueblo Municipal Code as amended hereby as the same existed on December 31, 2004. FITZGERALD FIRE DEPARTMENT, CHIEF CHRISTOPHER RILEY AN ORDINANCE AMENDING SECTION 6 OF CHAPTER 8 OF TITLE VI OF THE PUEBLO MUNICIPAL CODE RELATING TO THE ELIGIBLE LIST FOR ENTRY LEVEL FIREFIGHTERS ISSUE Should the number of eligibles certified from the Firefighter entry-level eligibility list be changed from five (5) to twenty (20)? BACKGROUND Due to the recent success of entry-level firefighter recruitments for the Fire Department, it has been determined by the Fire Chief, Acting Human Resources Director and the City Manager to continue with aggressive and enhanced recruitment efforts to target qualified candidates. On October 12, 2004, the City Council approved Ordinance 7217 that changed Section 6 of Chapter 8 of Title VI of the Pueblo Municipal Code extending the certification allowance of eligible individuals for entry-level firefighterfrom five (5) to twenty (20). However, on January 1, 2008 the amending Ordinance 7217 was automatically repealed and Pueblo Municipal Code was returned to its prior language. This Ordinance will extend the rule of twenty (20) to January 1, 2011. RECOMMENDATION Approval of the Ordinance. FINANCIAL IMPACT None: This Ordinance will reinstate the previous changes of the number of certified names that Human Resources will receive from the Civil Service Commission regarding entry level Firefighters.
