SECTION 1. Section 44 of Chapter 3 of Title XI of the Pueblo Municipal Code is amended to read as follows: Sec. 11 -3 -44. Fees [The fees for both investigation and issuance of a special event permit are: (1) Twenty -five dollars ($25.00) per day for a malt beverage permit; (2) Twenty -five dollars ($25.00) per day for a malt, vinous and spirituous liquor permit.] u The fee for investigation and issuance of a special event permit is one hundred dollars ($100.00) per permit. u All such fees are payable at the time application for a special event permit is made. The Liquor and Beer Licensing Board as local authority may require any applicant to post a performance bond to assure compliance with the provisions of this Article. SECTION 2. This Ordinance shall become effective thirty (30) days after final passage and approval. RECOMMENDATION Administrative Staff and the Liquor and Beer Licensing Board recommend adoption of the Ordinance. BACKGROUND Pursuant to recent enactment of Senate Bill 97 -149 by the General Assembly of the State of Colorado, the fee, which may be assessed by a local license body for investigation and issuance of a special event permit, has been increased to $100.00. It is the position of the Division of Liquor and Tobacco Enforcement of the State of Colorado that a local licensing body may no longer collect a per diem fee, i.e. twenty -five dollars ($25.00) per day. FINANCIAL IMPACT As most special events do not last longer than three days, it is not anticipated that this change will have a significant impact on the actual fees collected, and may result in an increase in such fees.
