HomeMy WebLinkAbout07720Reception 1794566 01/30/2009 ORDINANCE N0. 7720 AN ORDINANCE APPROVING AN AMENDMENT TO THE SPECIAL AREA PLAN FOR THE VILLAS AT EAGLERIDGE, A SPECIAL AREA PLAN WHEREAS, a request for an amendment to the Special Area Plan for a portion of the Villas at Eagleridge, A Special Area Plan, has been submitted to the Planning and Zoning Commission for approval pursuant to Section 17 -4-29 of the Pueblo Municipal Code, and WHEREAS, the Planning and Zoning Commission after a public hearing found and determined the objectives and requirements of said Section 174-29 can and will be met, and WHEREAS, the Planning and Zoning Commission has recommended the approval of the amendment to the Special Area Plan for the Villas at Eagleridge: that: NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, SECTION 1. The Special Area Plan for: Lots 5 and 6, Block 1, Villas at Eageridge, A Special Area Plan is hereby amended in accordance to the attached Exhibit A. SECTION 2. PACHECO, ASSISTANT CITY MANAGER FOR COMMUNITY DEVELOPMENT TITLE AN ORDINANCE APPROVING AN AMENDMENT TO THE SPECIAL AREA PLAN FOR THE VILLAS AT EAGLERIDGE, A SPECIAL AREA PLAN 1 1 ; 1-71 ! 1 1 Shall City Council approve a minor amendment to Lots 5 & 6, Block 1, Villas at Eagleridge, a Special Area Plan to allow the construction of two (2) single - family detached structures rather than the approved one (1) single - family attached structure on Lots 5 and 6? The Planning and Zoning Commission, at their October 10, 2007 regular meeting, voted 5 -0 -1 to recommend approval. BACKGROUND The applicant is requesting that the Villas at Eagleridge Special Area Plan be amended to allow the construction of two (2) single - family detached structures rather than the approved one (1) single - family attached structure on Lots 5 and 6. The developer has found that there is a greater demand for the detached structures; therefore, the developer would like to amend the established building footprints to accommodate detached structures. The proposed amendment will require a realignment of the building envelopes and a slight change in the setback requirements. The proposed minimum side -yard setback for the two lots will be reduced to 4.5 feet. The front and rear -yard setbacks will remain the same. All of the previously platted easements will remain in tact. FINANCIAL IMPACT None.
