HomeMy WebLinkAbout07713Reception 1756318 01/30/2008 ORDINANCE NO. 7713 AN ORDINANCE VACATING THE EXISTING PUBLIC UTILITY EASEMENT LOCATED ALONG THE NORTHEASTERN PORTION OF LOT 2, HISTORIC ARKANSAS RIVERWALK PROJECT, FILING NO. 2 BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: SECTION 1. The following described public utility easement: An Easement Vacation, located in the West 1/2 of Section 36, Township 20 South, Range 65 West of the 6th P.M., City of Pueblo, County of Pueblo, State of Colorado, with all of the bearings contained herein based upon a bearing of S44 0 42'35 "W as measured between the City of Pueblo control monuments at the intersection of Union Ave. and Grand Ave., being marked on the ground by a 3 1/4" aluminum cap, marked JR ENG LTD RLS 31161, found in place, and the intersection of Union Ave. and "E" St., being marked on the ground by a 3 114" aluminum cap, marked JR ENG LTD RLS 31161, found in place, said Easement vacation being more particularly described as follows: Commencing at a point on the centerline of said Union Ave., from where said monument at the intersection of Union Ave. and Grand Ave. bears N44 °42'35 "E, 153.58 feet; thence leaving said centerline, N45 0 17'25 "W, 50.00 feet, to an angle point on the Northerly line of Parcel A, Historic Arkansas Riverwalk Project, Filing No. 1, recorded in the office of the Pueblo County Clerk and Recorder at Reception No. 1289663, also being a point on the Westerly right -of -way line of said Union Ave.; thence along said Parcel A and said Westerly right -of -way line, the following two (2) courses: 1) S44 °42'35 "W, 86.11 feet, 2) N40 °05'07 "W, 8.03 feet, to the Northeast corner of Lot 2, said Filing No. 1, and the true point of beginning; thence along the North line of said Lot 2, also being the South line of a Public Utility Easement, recorded at said Reception No., the following two (2) courses: 1) N40 °0607 "W, 114.81 feet, 2) N44 °24'42 "W, 89.29 feet, to the Northwest comer of said Lot 2; thence continuing along said South line, N44 °24'42 "W, 19.29 feet; thence leaving said South line, along the following seven (7) courses: 1756318 ORD 01/30/2008 01:58:22 PM Page: 2 of 2 R 11.00 D 0.00 T 11.00 Gilbert Ortiz Clerk /Recorder, Puebla County, Cc ■III M IyG1«Fvi Ni � iMM M M II I 1) N44 °43'35 "E, 2.09 feet, 2) S45 °16'25 "E, 118.81 feet. 3) N44 °43'35 "E, 1.62 feet, 4) S45 °16'25 "E, 22.33 feet, 5) S44 °43'35 "W, 1.62 feet, 6) S45 °16'25 "E, 80.76 feet, 7) S44 °43'35 "W, 14.09 feet, to the true point of beginning. is hereby vacated. PACHECO, ASSISTANT CITY MANAGER FOR COMMUNITY DEVELOPMENT TITLE AN ORDINANCE VACATING THE EXISTING PUBLIC UTILITY EASEMENT LOCATED ALONG THE NORTHEASTERN PORTION OF LOT 2, HISTORIC ARKANSAS RIVERWALK PROJECT, FILING NO. 2 ISSUE Shall City Council approve the proposed vacation of the existing public utility easement in order to remove encumbrances from the building site? RECOMMENDATION The Planning and Zoning Commission, at their November 14, 2007, regular meeting, voted 6 -0-1 to recommend approval. BACKGROUND The City proposes to vacate a public utility easement along the northeastern portion of Lot 2, Historic Arkansas Riverwalk Project, Filing No. 2. This request is the last step in finalizing the Professional Bull Riders Association's economic development project. The recently amended subdivision, which was approved on August 27, 2007, reconfigured Lot 2 and the proposed vacation will remove encumbrances from the building site. FINANCIAL IMPACT None.
