AN ORDINANCE AMENDING THE DEVELOPMENT GUIDE FOR THE AREA COMMONLY
KNOWN AND DESCRIBED AS BELMONT PLACE PUD APPROVED BY ORDINANCE NO. 7552
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The Development Guide for the Belmont Place Planned Unit Development approved by Ordinance
No. 7552 establishing zoning restrictions covering the following described property:
The W 1/2 of the SW 1/4 and that portion of the W 1/2 of the NW 1/4 in Section 21, Township 20
South, Range 64 West of the 6th P.M., lying South of the Southerly right -of -way line of Colorado
State Highway No. 47 and excepting therefrom parcels conveyed in Book 1905 at Pages 816, 819
and 823.
upon the recommendation of the Planning and Zoning Commission, is hereby amended. The
Development Guide, attached hereto is hereby approved and shall be substituted for and replace
the Development Guide approved by Ordinance No. 7552.
SECTION 2.
This Ordinance shall become effective immediately upon final passage and approval.

ISSUE
Shall City Council approve a request to amend a previously approved 114 -acre PUD to
accommodate the realignment of the residential street pattern and trail alignment?
RECOMMENDATION
The Planning and Zoning Commission, at their November 14 2007 regular meeting,
voted 5 -0 -2 to recommend approval.
Applicant proposes to amend a previously approved 114 -acre PUD, Planned Unit
Development Zone District in order to accommodate the realignment of the residential
street pattern and trail alignment. As proposed, the PUD provides four (4) land use
areas listing specific permitted uses and standards for each area.

Belmont Place Development Guide
I. INTRODUCTION
A. Statement of Purpose
This document shall serve as a guideline for the implementation of design
standards for the Belmont Place Development by providing, in detail, the
objectives of the development.
These guidelines will assist in providing a definitive set of objectives and the
intended community design character, whereby any impacts on the
surrounding neighborhood will be mitigated.
Project Narrative
Belmont Place is a planned mixed residential and commercial district, parallel to
Troy Avenue from Hwy 47 to Constitution Avenue, consisting of approximately
114 acres in northeast Pueblo, Colorado. The design is intended to continue the
tradition of the original Belmont area with English - Chemed streets which will
create a sense of community and identity, while employing a transitional land
use between an older mobile home park, a newer 97 -unit apartment complex
and newer mini storage and gas /convenience store, The development will be
moderate in density. The design will emphasize single family and multi - family
use, along with a commercial service area. The PUD shall enable the developer
to provide a cohesive community for entry level and move -up buyers to the
surrounding Belmont neighborhoods.
The development will enable the subject property cleaned with the removal of
dead trees and trash, re- establishing and preserve the natural arroyos where
possible. Once developed, the property will contain large areas of greenbelt,
parks and hiking trails as an aesthetic enhancement as well as an additional
buffer to the adjoining neighborhoods. The overriding architectural features
shall reflect a Southwest Modern theme for Cl according to City guidelines, with
the architecture of Phase I setting the architectural theme for future phases.
Covenants will provide the architectural control of residential districts.
It is anticipated that final approvals for the PUD development will be in place by
March 2007 and allow for a 2nd quarter 2008 groundbreaking of Phase 1 (C1,
SFD -1). Phase 2 (MFDI is anticipated to be complete by 4th quarter 2015.
Phase 3 (MFD -2 is expected to begin in the 1 st quarter of 2014 and be
completed by 2nd quarter of 2017
Directly to the east are two high density uses of the Wagon Wheel Mobile Home
Park and the Preserve at Belmont a 97 unit apartment complex. To the
northeast is a gas /convenience store and mini storage facility. To the east is
vacant land not annexed to the city and to the south is vacant land within the
city limits but undeveloped.

Primary goals and objectives for this project include;
- To satisfy a need for new entry level and "move -up" product in Pueblo's
northeast corridor;
- To create a community that offers a positive social environment;
- To help spur additional new development on the eastern edge of town;
To aesthetically enhance the transportation infrastructure with a high ratio
of open space, parks, hiking and biking paths, walkways and pedestrian
sidewalks with connectivity to CSU- Pueblo and future development to the
north of Hwy 47.,
- To develop a commercial project that creates a buffer and source of
services between the community and Highway 47.
Impact assessments
Phase 1 environmental reports confirm there are no negative environmental
impacts. There are no endangered species, habitats or environmental hazards
on the property, Great care was taken to preserve an exceptional amount of
open space in the development to provide natural habitat and a sense of
natural surroundings. Since there are no public facilities in the immediate area
without going west to Belmont, the public facilities of parks and open space will
add new public facilities to be enjoyed by Belmont Place residents and
surrounding neighbors.
The property is being developed in compliance with all of the City's
environmental standards, including storm water runoff on surface waters. In the
area of Constitution Road drainage plan helps solve some historical drainage
problems of prior established developments.
There is no negative impact on East High School and the elementary and
middle schools serviced by this area, Schools in this area are not overcrowded
and have room for growth. In addition, the dog park presents anew social
interaction for both area residents and their canine partners that have
expanded rapidly throughout other areas of Colorado.
B. Definition - Planned Unit Development Mixed Residential and Commercial
Districts
These definitions are provided for clarification of uses proposed by the
Development Guidelines. Unless otherwise stated herein, all provision of and
definitions found in the Pueblo Municipal Code shall apply.
SFD =1 means single - family residential development with low to medium
density
i. Single Family Attached means two (2) dwelling units, each owned
in fee and located on individual lots, but joined along a single lot
line, each of which is totally separated from the other by a
common, unpierced, vertical wall.

2. MFD -2 means single and multifamily development to provide areas of
medium density characterized by condo and townhome style product
transitioning to single family.
3. MFD -1 means multi - family development.
4. C -1 means a limited Commercial land use area containing office,
greenhouse /nursery, and general retail land use in the form of in -line
space in a neighborhood retail center.
5. USBR means a use by special review as processed according to Section
17 -5-33 of the Pueblo Municipal Code,
6. GREENBELT means passive open space which may include pedestrian
trails.
7. PARK means active recreational park space.
B. Park DP means dogpark.
C. Legislative Intent
It is the intent of this Development Guide to be consistent with and the assist in
the implementation of the City of Pueblo's Zoning Ordinance to:
1. Minimize the burden of traffic on streets and highways;
2. Conserve and enhance the value of the land;
3. Provide a procedure which can relate the type and layout of the building
development to the particular site.
D. Application
These standards shall apply to all property contained within the Belmont Place
PUD that is shown on the attached plan. The regulations and requirements shall
become the governing standards for review, approval and modification of all
development activities occurring on the site.
Provisions of this guide shall prevail and govern the uses permitted within the
Belmont Place PUD; however, this guide shall only supersede the specific zoning
regulations of the City when referenced within the Development Guide and the
City's Zoning Ordinance as amended. The PUD Development Plan shall satisfy
the requirements of Section 12 -4 -5 (A) of the Pueblo Municipal Code covering
the overall development plan.
II. AUTHORITY
A. Authority
The authority of this Development Guide is Chapter 8 of Title XVII of the Pueblo
Municipal Code as amended.
B. Adoption
Reference: Section 17 -8 -8J of the City of Pueblo Municipal Code

C. Relationship of City Regulations
The provisions of the Development Guide shall prevail and govern development
of Belmont Place PUD except where the provisions of the Development Guide do
not clearly address a specific subject, or where there is a conflict. In such a case
the provisions of the City of Pueblo Zoning Ordinance, or any other codes or
regulations of the Large Scale Development Standards (Reference: Sec 17 -4 -46
Large -scale development performance standards) for the City of Pueblo shall
prevail where applicable.
D. Enforcement
The provisions of the Development Guide relating to the use of land shall run in
favor of the City of Pueblo and shall be enforceable, at law or in equity, by the
City of Pueblo,
Ill. CONTROL PROVISIONS
A. Control Over Use
After the adoption of this Development Guide by the City Council:
1. Any new building or other structure, and any parcel of land may be used in
accordance with the provisions of this Development Guide and Plan.
2. The use of any existing building, other structure, or parcel of land may not be
changed or extended except for those uses provided for by this
Development Guide.
B. Control Over Locations and Bulk
After the adoption of this Development Guide by the City Council, the location
and bulk of all buildings and other structures built after the effective date of the
Development Guide, shall be in conformance with:
1. All applicable standards contained within the Development Guide: and
2. Any other applicable standards contained within the City of Pueblo Large
Scale Development Standards.
3. Multi - Family regulations contained in Section 17 -4 -4 of the Pueblo Municipal
Code.
4. Signage and landscape regulations for residential land uses shall comply with
similar categories of uses as contained in the Pueblo Municipal Code and as
determined by the Planning Commission.
IV. DEVELOPMENT STANDARDS
A. COMMERCIAL DISTRICT: C -1
The proposed Commercial Districts are intended to provide small -scale
convenience retail and personal service uses that are pedestrian oriented
and neighborhood serving. These commercial uses will be scaled
appropriately to ensure that they are compatible with both existing and
planned neighborhoods. Architecture shall be a Southwest Modern

interpretation. At a minimum all construction shall comply with Section 17 -4-
46 (e) of the Pueblo Municipal Code.
B. RESIDENTIAL DISTRICT: SFD -1
The proposed Residential Districts are intended to provide entry level and
move -up housing market product for the Belmont area. Low to medium
density of 4 -6 units per ace is proposed in SFD -1 combined with a clustered
semi - attached product as a buffer and transition from the Preserve at
Belmont and Commercial District entering from Troy Avenue on Drew Dix,
C. RESIDENTIAL DISTRICT: MFD -1
The proposed Residential District is intended to provide entry -level product for
the Belmont area, Higher density of 12 -15 units per acre of multifamily
transitioning from the Wagon Wheel Mobile Home Park is proposed in MFD -1
combined with a clustered semi - attached product as a buffer and transition
to single - family medium density coming from Troy Avenue on Dick Trefz and
Constitution Avenue.
D. RESIDENTIAL DISTRICT: MFD -2
The proposed Residential District is intended to provide entry level and move -
up housing market product for the Belmont area. Medium density of 6 -12
units per acre is proposed in MFD -2 combined with a clustered semi - attached
product entering from Troy Avenue on Dick Trefz and Constitution Avenue.
