The following described drainage easement: A parcel of land located within the northwest one - quarter of Section 21 South, Range 65 West of the 6"' Principal Meridian, City and County of Pueblo, being described as a portion of Lots 4 and 5, Block 52, El Camino Subdivision 17` Filing, as recorded at Reception No. 1520720, and recorded in the Office of the Clerk and Recorder of Pueblo County, Colorado Being more particularly described as follows: A 10 foot drainage easement, 5 foot on each side of the common line described as Lots 4 and 5, excepting therefrom any portion lying within the 5' puelde parallel to the westerly line of said Lots 4 and 5 is hereby vacated. SECTION 2. PACHECO, ASSISTANT CITY MANAGER FOR COMMUNITY DEVELOPMENT TITLE AN ORDINANCE VACATING THE EXISTING DRAINAGE EASEMENT LOCATED BETWEEN LOTS 4 & 5, BLOCK 52, EL CAMINO SUBDIVISION, 17 FILING ISSUE Shall City Council approve the proposed vacation of the existing drainage easement in order to facilitate a change in the property dimensions? RECOMMENDATION The Planning and Zoning Commission, at their November 14, 2007, regular meeting, voted 7 -0 to recommend approval. BACKGROUND The owners of the subject properties propose to vacate the existing drainage easement located between lots 4 & 5 to facilitate a change in property dimensions. A home has been constructed on lot 4, and a garage built on the lot line between Lots 4 & 5. The owners are proposing to move the lot lines to allow for lot 5 to be developed as an individual parcel. This requires that the current drainage easement be vacated and realigned to match the proposed new lot line. FINANCIAL IMPACT None.
