TITLE
AN ORDINANCE VACATING A PORTION OF THE EXISTING INGRESS /EGRESS
AND DRAINAGE EASEMENTS LOCATED IN THE NORTHERN PORTION OF LOT 2,
VILLAGER INN SUBDIVISION
ISSUE
Shall City Council approve the proposed vacation of a portion of the existing
ingress /egress and drainage easements in order to facilitate the development of the La
Vittoria Subdivision?
The Planning and Zoning Commission, at their September 12, 2007, regular meeting,
voted 7 -0 to recommend approval.
BACKGROUND
The applicant proposes to vacate a portion of the existing ingress /egress and drainage
easements located in the northern portion of Lot 2 of the Villager Inn Subdivision. Lot 2
of the Villager Inn Subdivision is being resubdivided to include a portion of the Pueblo
Country Club Golf Course. Along with this subdivision, the platted 40' ingresslegress
and drainage easements need to be vacated to facilitate future development of the site.
The proposed drainage easement vacation will require the existing detention pond to
be moved to a different location and a new drainage easement will be redefined in the
new plat. The existing ingress /egress easement provides access from the frontage
road to Lot 1 of the Villager Inn Subdivision. The applicant has provided a 40 -foot wide
access and parking easement via separate document and as part of this document they
will provide an exhibit showing the access when it is physically constructed.
FINANCIAL IMPACT
None.
