HomeMy WebLinkAbout07676Reception 1768297 05/08/2008 ORDINANCE NO. 7676 AN ORDINANCE APPROVING A SPECIAL AREA PLAN FOR LAREDO AT PARKSIDE, FILING NO. 2, A SPECIAL AREA PLAN WHEREAS, A request for a Special Area Plan for a portion of Laredo at Parkside, A Special Area Plan, has been submitted to the Planning and Zoning Commission for approval pursuant to Section 17 -4 -29 of the Pueblo Municipal Code, and WHEREAS, the Planning and Zoning Commission after a public hearing found and determined the objectives and requirements of said Section 17 -4 -29 can and will be met, and WHEREAS, the Planning and Zoning Commission has recommended the approval of the Special Area Plan for Laredo At Parkside, Filing No. 2: NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Special Area Plan for: A resubdivision of a parcel of land located in a portion of Laredo at Parkside, A Special Area Plan and Amendment No. 1 to the Special Area Plan of: Laredo at Parkside A Special Area Plan in the County of Pueblo, State of Colorado and being more particularly described as follows: All of Lots 25 through 68 both inclusive Block 7, All of Blocks 8, 9, 10 and 11 and Parcels J, M and O, in Laredo at Parkside, A Special Area Plan according to the recorded plat thereof as filed for record at Reception No. 1414302 and Amendment No. 1 to the Special Area Plan of: Laredo at Parkside a Special Area Plan according to the recorded plat thereof as filed for record at Reception No. 1499732 in the Pueblo County records. Containing 8.30 acres more or less attached hereto, is hereby approved. SECTION 2. This ordinance shall become effective immediately upon final passage and approval. PACHECO, ASSISTANT CITY MANAGER FOR COMMUNITY DEVELOPMENT TITLE AN ORDINANCE APPROVING A SPECIAL AREA PLAN FOR LAREDO AT PARKSIDE, FILING NO. 2, A SPECIAL AREA PLAN ISSUE Shall City Council approve the Special Area Plan to facilitate the construction of single - family detached structures on 65 lots, within an 8.30 -acre area? The Planning and Zoning Commission, at their August 8, 2007 regular meeting, voted 5 -0 to recommend approval. BACKGROUND The applicant is requesting the Special Area Plan to facilitate the construction of single- family detached structures on 65 lots, within an 8.30 -acre area. The Special Area Plan will allow the property to be developed in a manner that would not be permissible under the R4 Zoning Code. Front -yard setbacks will be reduced by 10 feet and the side -yard setbacks of three (3) lots will be reduced by two (2) feet. The minimum lot frontage requirements and maximum lot coverage restrictions will also,be relaxed allowing the entire building envelope to be developed. The submitted Special Area Plan does not contain provisions for detached accessory structures outside of the building envelopes. Even though the yard and bulk regulations within the district have been relaxed the overall net density of the area will comply with medium density requirement of the R-4 Zone District.
