ORDINANCE NO. 7673
AN ORDINANCE VACATING A PORTION OF C STREET
BETWEEN LAMKIN STREET AND 2 STREET,
ADJACENT TO LOT 1, BLOCK 29 AND LOT 16, BLOCK 28
TOWN OF SOUTH PUEBLO
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
A portion of C Street between Lamkin Street and 2 Street, adjacent to Lot 1,
Block 29 and Lot 16, Block 28 Town of South Pueblo and more particularly described
as follows:
All of "C" Street adjacent to Lot 1, Block 29, and Lot 16, Block 28, South
Pueblo, County of Pueblo, State of Colorado, and that portion of "C"
Street described as:
Beginning at the NE corner of Lot 16, Block 28 thence Northeasterly
extending the Northeasterly property line of Block 28 a distance of 10 feet
to the centerline of Alley; Thence Northeasterly along the centerline of
alley a distance of 40 feet to the centerline of "C' Street; Thence
Northwesterly along the centerline of "C" Street a distance of 10 feet;
Thence Southwesterly along the Easterly property line of Block 29 if
extended Southwesterly a distance of 40 feet to Point of Beginning.
is hereby vacated.
SECTION 2.
This Ordinance shall become effective immediately upon final passage and
approval.

ISSUE
Shall City Council approve the vacation of a portion of C Street between Lamkin Street
and 2 Street, Adjacent to Lot 1, Block 29 and Lot 16, Block 28 Town of South Pueblo?
RECOMMENDATION
The Planning and Zoning Commission, at their September 12, 2007 Regular Meeting,
voted 7 -0 to recommend approval.
BACKGROUND
The applicant proposes to vacate a portion of C Street between Lamkin Street and 2nd
Street to connect the Rio Grand Yard property and the Pueblo Railway Foundation
property. Currently, this portion of C Street is unimproved gravel and serves as a dead
end into the existing rail yard. According to the applicant, this area is not maintained
and is often used as a "trash dump." The vacation will allow a new rail yard to be
constructed which will provide passage for antique train cars to moved into the
restoration shop for maintenance. The project will ultimately improve the aesthetic
appearance of that area.

Pueblo Railway Foundation, a Colorado Non - Profit Corporation grantor, and
City of Pueblo, a Municipal Corporation
whose legal address is One City Hall Place
of the County of Pueblo, and State of Colorado, grantee,
WITNESSETH, That the grantor for and in consideration of the sum of One Dollar and other good and
valuable consideration the receipt and sufficiency of which is hereby acknowledged, has remised, sold and
conveyed and by these presents does remise, release, sell and convey unto the grantee, its successors
and assigns, forever, all the real property, together with improvements, if any, situate, lying and being in the
County of Pueblo and State of Colorado, described in Exhibit "A" attached hereto and incorporated herein.
TO HAVE AND TO HOLD the same, together with all and singular the appurtenances and privileges
thereunto belonging or in anywise thereunto appertaining, and all the estate, right, title, interest and claim
whatsoever, of the grantor, either in law or equity, to the only proper use, benefit and behoof of the grantee,
its successors and assigns forever.
Grantor warrants to grantee and its successor and assigns the quiet and peaceful possession of the
real property and will defend title thereto against all persons claiming to hold title by, through or under the
grantor.
IN WITNESS WHEREOF, The grantor has executed this deed on the date set forth above.
