HomeMy WebLinkAbout07661Reception 1760770 03/06/2008 ORDINANCE NO. 7661 AN ORDINANCE APPROVING A SPECIAL AREA PLAN FOR LA BELLA VITA AT VENTANA WHEREAS, A request for a Special Area Plan for Lot 17, Block 1, Ventana, Filing No. 1, has been submitted to the Planning and Zoning Commission for approval pursuant to Section 17 -4-29 of the Pueblo Municipal Code, and WHEREAS, the Planning and Zoning Commission after a public hearing found and determined the objectives and requirements of said Section 17 -4 -29 can and will be met, and WHEREAS, the Planning and Zoning Commission has recommended the approval of the Special Area Plan for Lot 17, Block 1, Ventana, Filing No. 1: NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Special Area Plan for: All of Lot 17, Block 1, Ventana Filing No. 1 according to the recorded plat filed for record at Reception No. 1564174 in the Pueblo County records EXCEPTING THEREFROM: A portion of said Lot 17, Block 1, Ventana, Filing No. 1 being more particularly described as follows: Beginning at the most Southerly corner of Lot 17, Block 1, Ventana, Filing No. 1, said point also being on the Northerly right -of -way line of Colorado State Highway 78 as presently located; thence N. 36 0 59'16" W., a distance of 218.81 feet to a point on the Southeasterly right -of -way line of Ventana Circle as presently located; thence N. 52 0 37'07" E. along the Southeasterly right -of -way line of said Ventana Circle, a distance of 85.51 feet; thence continuing along the Southeasterly right -of- way line of said Ventana Circle along the arc of a curve to the left whose radius is 530.00 feet, a distance of 77.52 feet; thence S. 45 0 45'41" E., a distance of 227.68 feet to a point on the Northerly right -of -way line of said Colorado State Highway No. 78 and the Point of Beginning. PACHECO TITLE AN ORDINANCE APPROVING A SPECIAL AREA PLAN FOR LA BELLA VITA AT VENTANA ISSUE Shall City Council approve the Special Area Plan to facilitate the construction of single - family attached structures on 28 lots, within a 7.516 -acre area? RECOMMENDATION The Planning and Zoning Commission, at their August 8, 2007 regular meeting, voted 5 -0 to recommend approval. BACKGROUND The applicant is requesting the Special Area Plan to facilitate the construction of single - family attached structures on 28 lots, within a 7.516 -acre area. The Special Area Plan will allow the property to be developed in a manner that would not be permissible under the standard R -2U Zoning Code. The common lot lines between each set of lots will be reduced to zero (0) feet to allow construction of single - family attached residences. Front yard setbacks adjacent to Ventana Court will be set at 12 feet and the front yard setbacks adjacent to Colorado State Highway 78 and Ventana Circle will be reduced to 15 feet, increasing the buildable area of each lot. The minimum lot area and width requirements will also be relaxed, however the overall net density of the area will comply with medium density requirement. FINANCIAL IMPACT None.
