ORDINANCE NO. 7654
AN ORDINANCE APPROVING A SPECIAL AREA PLAN FOR LOTS 1 THROUGH 10
AND LOTS 32 THROUGH 39, BLOCK 2, IVYWOOD SUBDIVISION
WHEREAS, A request for a Special Area Plan for Lots 1 through 10, and Lots 32
through 39, Block 2, Ivywood Subdivision, has been submitted to the Planning and Zoning
Commission for approval pursuant to Section 17 -4 -29 of the Pueblo Municipal Code, and
WHEREAS, the Planning and Zoning Commission after a public hearing found and
determined the objectives and requirements of said Section 17 -4 -29 can and will be met, and
WHEREAS, the Planning and Zoning Commission has recommended the approval of
the Special Area Plan for Lots 1 through 10 and Lots 32 through 39, Block 2, Ivywood
Subdivision:
NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1. .
The Special Area Plan for:
A TRACT OF LAND IN THE SOUTHEAST 1/4 OF SECTION 10, TOWNSHIP
21 SOUTH, RANGE 65` WEST OF THE 6TH P.M., MORE PARTICULARLY
DESCRIBED AS FOLLOWS:
COMMENCING AT A POINT 30 FEET NORTH AND 25 FEET EAST OF
THE S.E. CORNER, OF THE, NW 1/4 OF THE SE 1/4 OF THE SE -I/4 OF
SECTION 10, TOWNSHIP 21 SOUTH, RANGE 65 WEST: THENCE NORTH
PARALLEL WITH THE EAST LINE OF THE SAID NW 1/4 OF THE SE 1/4
OF THE SE 1/4 300 FEET; THENCE WEST 25 FEET TO THE EAST LINE OF
THE NW 1/4 OF THE SE 1/4 OF THE SE 1/4; THENCE NORTH ALONG
THE EAST LINE OF SAID NW 1/4 OF THE SE 1/4 OF THE SE 1/4 TO THE
SOUTH LINE OF HILBERT AVENUE; THENCE WEST ALONG THE
SOUTH LINE OF HILBERT AVENUE 25 FEET; THENCE SOUTH AND

AN ORDINANCE APPROVING A SPECIAL AREA PLAN FOR LOTS 1
THROUGH 10 AND LOTS 32 THROUGH 39, BLOCK 2, IVYWOOD
SUBDIVISION
ISSUE
Shall City Council approve the Special Area Plan to facilitate the construction of single -
family attached single - family residences into 60 residential lots?
RECOMMENDATION
The Planning and Zoning Commission, at their June 13, 2006 regular meeting, voted
7 -0 to recommend approval.
BACKGROUND
The proposed Special Area Plan and subdivision will plat the 10.55 -acre property into 60
residential lots. The Special Area Plan will facilitate the construction of single - family
attached residences around the perimeter of the development and single - family
detached residences within the interior. The Special Area Plan will allow the property to
be developed in a manner that would not be permissible under the standard R -2 Zoning
Code. Minimum side -yard setbacks for the common lot lines between the 18 lots
around the perimeter of the development will be reduced to zero (0) feet to allow the
construction of single - family attached residences. The minimum lot area and width
requirements will also be relaxed, however the overall net density of the area will comply
with the requirements of the R -2 District.
FINANCIAL IMPACT
None.
