AN ORDINANCE CHANGING ZONING RESTRICTIONS FROM R -6 AND B -2 TO S -1 AND B -2
COVERING A PARCEL OF LAND COMMONLY KNOWN AS PORTIONS OF LOTS 1 -40, BLOCK
137, EAST PUEBLO HEIGHTS SUBDIVISION
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1 _
The zoning restrictions covering the following described property be changed from R -6,
Multiple Residential and Commercial District and B -2, Subregional Business District to S -1,
Governmental Use District and B -2, Subregional Business District, and upon passage of this
ordinance, zoning restrictions affecting S -1, Governmental Use District and B -2, Subregional
Business District, shall apply to said property:
R -6 and B -2 to S -1:
A portion of the Southeast Quarter of the Northeast Quarter of Section 29, Township
20 South, Range 64 West of the 6 th Principal Meridian, also being a portion of Block
127 and 137, East Pueblo Heights Subdivision Second Filing, County of Pueblo,
State of Colorado, and that portion of the vacated alley as described in Order No.
3299 lying within the boundary described below, and being more particularly
described as follows:
Basis of Bearings: The Centerline of Troy Avenue Between 15 and 16
Street, being monumented at both ends by a concrete
monument with lead plug and brass tack in a
monument box, assumed to bear N01 0 16'30 "W.
Commencing at the centerline monument at Troy Avenue and 15 Street, thence
N44 0"E, a distance of 42.11 feet to the southwest corner of said Block 137,
also known as the southwest corner of Parcel 2 as recorded in Book 2761 at Page
941, Pueblo County, Colorado, thence N01 °16'30 "W on the boundary of said Parcel
2, a distance of 84.94 feet to the northwesterly corner of said Parcel 2, said point
also being the point of beginning.
Thence N01 0 16'30"W on the easterly right -of -way line of Troy Avenue, a distance of
302.68 feet to a point on the southerly right -of -way line of Colorado State Highway
50B as described in the plans for federal aid Project No. 9(4); thence S53 0 51'36 "E,
on the southerly line of said right -of -way, a distance of 536.04 feet; thence
N65 0 44'08 "W, a distance of 449.69 feet to a point on the northerly line of said block
137; thence S01 0 16'30 "E, a distance of 156.87 feet to a point on the northerly line of
said Parcel 2; thence S53 0 43'59 "W on the northerly boundary of said Parcel 2, a
distance of 24.41 feet to the point of beginning;
Containing a calculated area of 29,398 sq. feet, or 0.675 acres, more or less.
R -6 and B -2 to B -2:
A portion of the Southeast Quarter of the Northeast Quarter of Section 29, Township

said Block 137; thence S65 0 44'08 "E, a distance of 449.69 feet to a point on the
southerly right -of -way line of Colorado State Highway 50B as described in the plans
for federal aid Project No. 9(4); thence S53 0 51'36 "E, on the southerly line of said
right -of -way, a distance of 93.48 feet to a point of the easterly line of said Block 137;
thence S01 °16'30 "E, on the easterly line of said Block 137, a distance of 5.26 feet to
the southeast corner of said Block 137; thence S88 0 44'22 "W, on the southerly line
of said Block 137, a distance of 300.00 feet to the southeast corner of said Parcel 2;
thence on the boundary of said Parcel 2 the following four (4) courses:
1. N01 0 16'30 "W a distance of 69.95 feet;
2. N61 °31'48 "W a distance of 100.74 feet;
3. S88 0 44'22 "W a distance of 62.59 feet;
4. S53 0 43'59 "W a distance of 36.55 feet to the point of beginning;
Containing a calculated area of 47,898 sq. feet, or 1.100 acres, more or less.
and more commonly known as:
property located southwest of Highway 50 Bypass, east of Salem Avenue, north of East
15 Street, and south of East 16 Street.
SECTION 2.
This Ordinance shall become effective immediately upon final passage and approval.

ISSUE
Shall City Council approve a request to rezone the property from R -6, Multiple
Residential and Commercial District, and B -2, Subregional Business District to S -1,
Governmental Use District and B -2, Subregional Business District, to facilitate
commercial development?
RECOMMENDATION
The Planning and Zoning Commission, at their June 13, 2007 regular meeting, voted 7-
0 to recommend approval.
BACKGROUND
Currently the property is vacant land. City of Pueblo staff have determined that a
portion of the property is excess property and may be sold for private development. As
proposed, the City may sell a portion of the property to the property owner to the south
and the remaining City property will be retained for future use as additional Highway 50
Bypass and Troy Avenue Right -of -Way.
