HomeMy WebLinkAbout07622ORDINANCE NO. 7622 AN ORDINANCE APPROVING A SPECIAL AREA PLAN FOR J.T SUBDIVISION WHEREAS, A request for a Special Area Plan for a portion of the NW' /4 of Section 14, Lots 25 through 48, Block 106, Lots 1 through 48, Block 109, Lots 1 through 5 and Lots 42 through 48, Block 124, and certain vacated streets and alleys adjacent thereto, Wiley's Park Heights, located within a portion of the NE '/4 of Section 15, all within Township 20 South, Range 65 West of the Sixth Principal Meridian, has been submitted to the Planning and Zoning Commission for approval pursuant to Section 17 -4 -29 of the Pueblo Municipal Code, and WHEREAS, the Planning and Zoning Commission after a public hearing found and determined the objectives and requirements of said Section 17 -4 -29 can and will be met, and WHEREAS, the Planning and Zoning Commission has recommended the approval of the Special Area Plan for Lots 6 and 7, Block 45, Stone and Thatcher without conditions: NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Special Area Plan for: THE EAST ONE -HALF OF BLOCK 108; ALL OF BLOCK 109 AND BLOCK 124, WILEY'S PARK HEIGHTS, LYING NORTH OF THE U.S. HIGHWAY 50 RIGHT OF WAY, AS PRESENTLY LOCATED, LESS PORTION DEEDED TO HIGHWAY, COUNTY OF PUEBLO, STATE OF COLORADO AND THE SOUTHWEST 1/4 OF THE NORTHWEST 1/4 OF SECTION 14, TOWNSHIP 20 SOUTH, RANGE 65 WEST OF THE 6TH P.M., AS FOLLOWS: BEGINNING AT THE NORTHWEST CORNER OF SAID SOUTHWEST 1/4 OF THE NORTHWEST 1/4 OF SECTION 14; THENCE EASTERLY ALONG THE NORTH LINE OF SAID SOUTHWEST 1/4 OF THE NORTHWEST 1/4, A DISTANCE OF 363 FEET; THENCE SOUTHERLY AND PARALLEL TO THE WEST LINE OF THE SAID SECTION 14, A DISTANCE OF 327.86 FEET, MORE OR LESS TO THE NORTHERLY RIGHT OF WAY LINE OF THE U.S. HIGHWAY NO. 50, AS PRESENTLY LOCATED; THENCE NORTHWESTERLY ALONG THE SAID NORTHERLY RIGHT OF WAY LINE TO THE WEST LINE OF THE SAID SOUTHWEST 1/4 OF THE NORTHWEST 1/4 OF SECTION 14; THENCE NORTHERLY ALONG THE WEST LINE OF THE SAID SOUTHWEST 1/4 OF THE NORTHWEST 1/4, TO THE POINT OF BEGINNING, COUNTY OF PUEBLO, STATE OF COLORADO. Said Parcel contains 10.75 acres, more or less, attached hereto, is hereby approved. SECTION 2. This ordinance shall become effective immediately upon final passage and approval. PACHECO LAND USE ADMINISTRATOR/JERRY M. PACHECO TITLE AN ORDINANCE APPROVING A SPECIAL AREA PLAN FOR J.T. SUBDIVISION ISSUE Shall City Council approve the Special Area Plan to facilitate the development of a residential and commercial project utilizing private roadways? RECOMMENDATION The Planning and Zoning Commission, at their May 9, 2007 regular meeting, voted 5 -0 to recommend approval. BACKGROUND J.T. Subdivision, A Special Area Plan will plat nine (9) single - family residential lots, and five (5) commercial lots. The area was originally platted as Wiley's Park Heights in 1890, for residential development, which was never developed according to the original design. The proposed Special Area Plan will allow the development of a private road, Brakeman Way and prevent the eastern adjacent properties from becoming through lots. In the event that the residential lots became through lots each lot would have to provide two (2) front setbacks for new development and footprint enlargements or alterations of existing structures. It is the recommendation of the SRC that the plat be approved; all deficiencies have been addressed. FINANCIAL IMPACT None.
