SUBDIVISION BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The zoning restrictions covering the following described property be changed from 1 -2, Light Industrial District and B -4, Regional Business District to R -2, Single - Family Residential District, B -P, Business Park District and B -4, Regional Business District, and upon passage of this ordinance, zoning restrictions affecting R -2, Single - Family Residential District, B -P, Business Park District and B -4, Regional Business District, shall apply to said property: LEGAL DESCRIPTION REZONED AREA (1 -2 TO R -2 ALL OF LOTS 25 THROUGH 48 BLOCK 108; ALL OF THE EAST HALF OF THE 15 FOOT WIDE ALLEY ADJACENT TO BLOCK 108 ALL OF OLIVE STREET FROM THE NORTHERLY RIGHT -OF -WAY LINE OF 40 STREET TO THE SOUTHERLY RIGHT -OF -WAY LINE OF 39 STREET; THAT PORTION OF 39TH STREET FROM THE WESTERLY RIGHT OF WAY LINE OF OLIVE STREET THE CENTERLINE OF THE 15 FOOT WIDE ALLEY IN BLOCK 109 IF EXTENDED NORTHERLY; THAT PORTION OF 40TH STREET FROM THE CENTERLINE OF THE 15 FOOT WIDE ALLEY ADJACENT TO BLOCK 108 IF EXTENDED NORTHERLY TO THE WESTERLY RIGHT -OF -WAY LINE OF OLIVE STREET; ALL WITHIN WILEY'S PARK HEIGHTS, ACCORDING TO THE RECORDED PLAT THEREOF FILED FOR RECORD MAY 31, 1890 IN BOOK 5 AT PAGE 43 IN THE RECORDS OF THE PUEBLO COUNTY CLERK AND RECORDER. SUBDIVISION ISSUE Shall City Council approve a request to rezone the property from 1 -2, Light Industrial District and B-4, Regional Business District, to R -2, Single - Family Residential District, BP, Business Park District, and B-4, Regional Business District to promote redevelopment of light industrial and commercial land for residential, business park and commercial projects? RECOMMENDATION The Planning and Zoning Commission, at their May 9, 2007 regular meeting, voted 5 -0 to recommend approval. BACKGROUND In order to accommodate the redevelopment project proposed by the J.T. Subdivision, A Special Area Plan, the 10.75 -acre site must be rezoned to accommodate the proposed uses. Previously, the northern portion of the site was used as a large Salvage Yard and is currently zoned 1 -2. The southern lots are zoned B-4 and.have remained vacant except for the proposed lot 14 which contains a small commercial enterprise. FINANCIAL IMPACT None.
