HomeMy WebLinkAbout07615Reception 1934592 02/20/2013 12:31:38 PM ORDINANCE NO. 7615 AN ORDINANCE VACATING A PORTION OF THE ALLEY LOCATED WITHIN BLOCK 110, SOUTH PUEBLO AND A PORTION OF "E" STREET ADJACENT TO BLOCK 110, SOUTH PUEBLO AND BLOCK 1, WILSON SUBDIVISION BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: SECTION 1. A portion of the alley located in Block 110, South Pueblo and a portion of E Street adjacent to Block 110, South Pueblo and Block 1, Wilson Subdivision, more particularly described as follows: A parcel of land located within the Southeast one - quarter of Section 36, Township 20 South, Range 65 West, of the 6 Principal Meridian and within the Southwest one - quarter of Section 31, Township 20 South, Range 64 West of the 6 Principal Meridian, in the City of Pueblo, County of Pueblo, State of Colorado, said tract or parcel being more particularly described as follows: Beginning at the most Easterly corner of Lot 16, Block 110 of South Pueblo; Thence, Northeasterly and perpendicular to the Northeast line of Lot 16, a distance of 12 feet; Thence, Southeasterly and parallel to the Northeast line of Lot 17, Block 110, South Pueblo to the intersection of the West right -of -way line of Santa Fe Avenue; Thence South and along the West right -of -way line of Santa Fe Avenue to the intersection of the Northeast line of Lot 17, Block 110, South Pueblo; Thence Northwest and along the Northeast line of Lot 17, Block 110, South Pueblo to the most northerly corner of Lot 17, Block 110, South Pueblo; Thence Southwesterly and along the Southeast line of the alley, a distance of 80 feet; Thence Northwesterly and perpendicular to the Southeast line of said alley a distance of 16 feet; 1934592 ORD 02/20/2013 12:31:38 PM Page: 2 of 2 R 16.00 D 0.00 T 16.00 Gilbert Ortiz Clerk /Recorder, Pueblo County, Co 11111 Thence Northeasterly and along the Southeast line of . a 4 foot Vacated Alley (Ordinance Introduced 11 -23 -1925) a distance of 80'; Thence Northwesterly and perpendicular to the Southeast line of said ordinance a distance of 4 feet to the Point of Beginning. PACHECO TITLE AN ORDINANCE VACATING A PORTION OF THE ALLEY LOCATED WITHIN BLOCK 110, SOUTH PUEBLO AND A PORTION OF "E" STREET ADJACENT TO BLOCK 110, SOUTH PUEBLO AND BLOCK 1, WILSON SUBDIVISION ISSUE Shall City Council approve a request to vacate the northerly 80 feet of the alley lying within Block 110 South Pueblo and the unvacated portion of "E" Street lying adjacent to Lot 17, Block 110, South Pueblo and adjacent to Block 1, Wilson Subdivision to add additional parking and traffic flow? RECOMMENDATION The Planning and Zoning Commission, at their April 11, 2007, regular meeting, voted 6 -0 to recommend approval. BACKGROUND The applicants proposes to vacate the northerly 80 feet of the alley lying within Block 110 South Pueblo and the un- vacated portion of E Street lying adjacent to Lot 17, Block 110, South Pueblo and adjacent to Block 1, Wilson Subdivision. The vacations are a part of the larger redevelopment of the Pueblo Ice House (old Alpha Beta Packing plant) development that involves a re- subdivision, PUD Site Plan, and a PUD rezoning. The vacated property will be utilizedfor additional parking and increased traffic flow. The adjoining landowners (ABC Plumping and Pueblo Ice House) will dedicate an ingress /egress, utility, drainage easement to allow for continued City access to both the alley and street. It is the recommendation of the Subdivision Review Committee (SRC) memo dated April 4, 2007 that the vacation be approved. FINANCIAL IMPACT None.
