HomeMy WebLinkAbout07612Reception 1758959 02/21/2008 ORDINANCE NO. 7612 AN ORDINANCE VACATING A FORTY FOOT DRAINAGE, A UTILITY EASEMENT, AND ROADWAY EASEMENT IN A PORTION OF NORTH PUEBLO COMMERCIAL PARK, FILING NO. 1, -fT AMENDMENT BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: SECTION 1. A forty foot drainage, a utility easement, and roadway easement in a portion of North Pueblo Commercial Park, Filing No. 1, 1 Amendment, and being more particularly described as follows: Considering the Northerly line of Lot 3, Block 2, in North Pueblo Commercial Park, Filing No. 1 to bear N. 57 0 59'48" E., and all bearing herein being relative thereto. Beginning at the Northwest corner of Lot 3, Block 2 in North Pueblo Commercial Park, Filing No. 1 according to the recorded plat thereof as filed for record at Reception No. 1027152; thence N. 57 0 59'48" E., along the Northerly line of said Lot 3, a distance of 314.14 feet to a point on the Westerly line of a 40 foot Drainage and Utility Easement recorded at Reception No. 1027152; thence S. 02 °28'05" E., along the Westerly line of the said Drainage and Utility Easement, a distance of 45.97 feet; thence S. 57 °59'48" W., a distance of 301.46 feet to a point on the Easterly right -of- way line of Dillon Drive as presently located; thence Northerly along the Easterly right -of -way line of said Dillon Drive along the arc of a curve to the left whose radius is 415.00 feet and whose center bears S. 74 °51'40" W., a distance of 41.24 feet.to the Point of Beginning, are hereby vacated. SECTION 2. This ordinance shall become effective immediately upon final passage and approval. PACHECO TITLE AN ORDINANCE VACATING A FORTY FOOT DRAINAGE, A UTILITY EASEMENT, AND ROADWAY EASEMENT IN A PORTION OF NORTH PUEBLO COMMERCIAL PARK, FILING NO. 1, 1 AMENDMENT ISSUE Shall City Council approve the vacations to facilitate the subdivision and subsequent development of the North Pueblo Commercial Park, Filing No. 1, 1"Amendment? RECOMMENDATION The Planning and Zoning Commission, at their May 9, 2007, regular meeting, voted 5 -0 to recommend approval. BACKGROUND North Pueblo Commercial Park, Filing No. 1, 1 Amendment is a resubdivision of a portion of North Pueblo Commercial Park, Filing No. 1 which was originally approved by the Planning and Zoning Commission on May 12, 1993. The subdivision was created in accordance with the North Pueblo Commercial Park Master Development Plan that was also approved May 12, 1993.. The proposed easement vacations will facilitate the commercial subdivision process. It is the recommendation of the Subdivision Review Committee (SRC) memo dated April 25, 2007 that the vacation be approved. FINANCIAL IMPACT None.
