HomeMy WebLinkAbout07609Reception 1745612 10/16/2007 ORDINANCE NO. 7609 AN ORDINANCE VACATING TWO DRAINAGE EASEMENTS WITHIN BLOCK 9, AND TWO PEDESTRIAN EASEMENTS WITHIN BLOCK 8, OF EAGLERIDGE ESTATES SUBDIVISION, FILING NO. 2 BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: SECTION 1. A portion of Eagleridge Estates, Filing No. 2 according to the recorded plat thereof as filed for record at Reception No's, 1690203, 1702444 and 1702445 in the Pueblo County ' records: EASEMENT No. 1 The Easterly 25 feet of the Drainage Easement located in Lot 1, Block 9, in said Eagleridge Estates, Filing No. 2. /ATr EASEMENT No. 2 Considering the East line of the NE '/4 of Section 11, Township 20 South, Range 65 West of the 6 P.M. to bear N. 00 °31'24" W., and all bearings contained herein being relative thereto. Beginning at the Southeast corner of Lot 1, Block 8 in said Eagleridge Estates, Filing No. 2 said point also being on the Northerly right -of -way line of Landmark Road and also being on the Westerly right -of -way line of Outlook Boulevard as presently located; thence N. 89 0 17'37 "W., a distance of 73.67 feet; thence continuing along the Northerly right -of -way line of said Landmark Road, Westerly along the arc of a curve to the right whose radius is 180.00 feet, a distance of 26.43 feet; thence N. 00 °42'23" E., a distance of 58.06 feet; thence S. PACHECO TITLE AN ORDINANCE VACATING TWO DRAINAGE EASEMENTS WITHIN BLOCK 9, AND TWO PEDESTRIAN EASEMENTS WITHIN BLOCK 8, OF EAGLERIDGE ESTATES SUBDIVISION;FILING-NO. 2 ISSUE Shall City Council approve the proposed vacation of easements in order to facilitate the development of the Bella Vista Subdivision? RECOMMENDATION The Planning and Zoning Commission, at their May 9, 2007, regular meeting, voted 5 -0 to recommend approval, BACKGROUND Eagleridge Estates Subdivision, Filing No. 2 was originally approved by the Planning and Zoning Commission on February 8, 2006. The original subdivision was created in accordance with the Eagleridge Estates Master Development Plan (Amended) that was approved October 11, 2000. The proposed easement vacations will facilitate the subdivision and subsequent development of the Bella Vista Subdivision. It is the recommendation of the Subdivision Review Committee (SRC) memo dated April 25, 2007 that the vacation be approved. FINANCIAL IMPACT None.
