AN ORDINANCE AMENDING PARAGRAPH (3) OF SUBSECTION (a), SECTION 12,
CHAPTER 4, TITLE XII OF THE PUEBLO MUNICIPAL CODE RELATING TO COST
RECOVERY OF STREET IMPROVEMENTS BY SUBDIVIDERS
BE IT ORDAINED BY THE CITY COUNIL OF PUEBLO, that: (brackets indicate matter
being deleted, underscoring indicates matter added)

Paragraph (3) of Subsection (a), Section 12, Chapter 4, Title XII, of the Pueblo Municipal
Code is hereby amended to read as follows:
(3) Incidentals means and includes, without limitation, storm sewers and appurtenances,
medians, acceleration and deceleration lanes, streets signs, traffic signals, [and I survey
monuments [.] construction traffic control, landscaping in medians, utility relocation, and
other unspecified incidental costs reasonably required and related to the street
improvements as determined by the Director.
SECTION 2
This Ordinance shall become effective immediately upon final passage and approval.

AN ORDINANCE AMENDING PARAGRAPH (3)'OF SUBSECTION (a), SECTION
12, CHAPTER 4, TITLE XII OF THE PUEBLO MUNICIPAL CODE RELATING TO
COST RECOVERY OF STREET IMPROVEMENTS BY SUBDIVIDERS
ISSUE
Should the City Council amend Section 12 -4 -12 (a)(3) of the Pueblo Municipal Code.
RECOMMENDATION
The Planning and Zoning Commission approved this amendment 5 -0 at their May 9,
2007, meeting.
This amendment would change the definition of `incidentals" to include construction
traffic control, landscaping in medians, utility relocation, and other unspecified incidental
costs if approved by the Director of Public Works.
FINANCIAL IMPACT
None.
