AN ORDINANCE VACATING A STREET RIGHT OF WAY AND TWO DRAINAGE
EASEMENTS LOCATED IN PARK WEST BUSINESS CAMPUS, FILING NO. 2
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that:
SECTION 1.
A portion of a street right -of -way and two drainage easements located in Park
West Business Campus, Filing No. 2, more particularly described as follows:
STREET VACATION DESCRIPTION:
The North 10 feet of 29 Street (future 31S Street) as platted in Park West Business
Campus, Filing No. 2 according to the recorded plat thereof as filed for record at
Reception No. 1555457 in the Pueblo County records.
EASEMENT VACATION DESCRIPTION:
Considering the South line of the SW '% of the SW Y, of Section 15, Township 20
South, Range 65 West of the 6 P.M. to bear N. 88 °42'57" E. and all bearing
contained herein being relative thereto.
All of Parcel A as platted in Park West Business Campus, Filing No. 2 according to
the recorded plat thereof as filed for record at Reception No. 1555457 in the Pueblo
County records;
AND
A portion of the 20 foot Drainage Easement located in Lot 2, Block 1 in Park West
Business Campus, Filing No. 2 being more particularly described as follows:
Beginning at the Southeast corner of Lot 2, Block 1 in said Park West Business
Campus, Filing No. 2, said point also being on the Southerly line of the SW '% of said
Section 15 and also being on the Westerly right -of -way line of Spaulding Avenue as
presently located; thence S. 88 °44'03" W., along the Southerly line of Lot 2, Block 1
in said Park West Business Campus, Filing No. 2, and the Southerly line of the SW
% of said Section 15, a distance of 364.63 feet; thence N. 51 °21'00" E., a distance of
25.61 feet; thence N. 88 0 44'03" E., a distance of 322.45 feet to a point on the
Westerly right -of -way line of said Spaulding Avenue; thence S. 39 °55'52" E., along
the Westerly right -of -way line of said Spaulding Avenue, a distance of 25.61 feet to
the Point of Beginning.

AN ORDINANCE VACATING A STREET RIGHT OF WAY AND TWO DRAINAGE
EASEMENTS LOCATED IN PARK WEST BUSINESS CAMPUS, FILING NO. 2
ISSUE
Shall City Council approve the vacation of a portion of 29 Street and a portion of a
drainage easement?
RECOMMENDATION
The Planning and Zoning Commission, at their April 11, 2007, regular meeting, voted 6 -0
to recommend approval.
BACKGROUND
Property is located in the vicinity of 31s and Spaulding Avenue.
The Park West Business_ Campus Filing No.2 was approved May 13, 2003. The applicant
plans to resubdivide portions of Park West Business Campus Filing No. 2, and two (2)
additional unplatted parcels in order to facilitate new commercial and multifamily
development. In advance of resubdivision the applicant must vacate a nine (9) acre
drainage easement (Parcel A), a 10 foot right-of-way' along 29 Street (being renamed to
31s Street), and a segment of a 20 -foot drainage easement adjacent to Spaulding
Avenue. The proposed resubdivision will replat rights -of -ways and necessary easements.
It is the recommendation of the Subdivision Review Committee (SRC) memo dated April
4, 2007 that the vacation be approved.. ,
