HomeMy WebLinkAbout07581ORDINANCE NO. 7581 AN ORDINANCE APPROVING AN AGREEMENT BETWEEN THE UNIVERSITY PARK NEIGHBORHOOD ASSOCIATION AND THE CITY OF PUEBLO, A MUNICIPAL CORPORATION AND AUTHORIZING THE PRESIDENT OF CITY COUNCILTO EXECUTE SAME, AND BUDGETING AND APPROPRIATING FUNDS RECEIVED IN THE AMOUNT OF $50,000 RELATING TO THE JERRY MURPHY STREETSCAPE PROJECT NO. CP0707 WHEREAS, the University Park Neighborhood Association, has committed funds through an Agreement; BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. Funds for the project in the amount of $50,000 from the University Park Neighborhood Association are hereby budgeted and appropriated into project CP0707, Jerry Murphy Streetscape Project. The total budget for said project is hereby increased to a total of $200,000. SECTION 2. The Agreement between Pueblo, a Municipal Corporation, and the University Park Neighborhood Association, a copy of which is attached, having been approved as to form by the City Attorney, is hereby approved. SECTION 3. The President of the City Council is authorized to execute and deliver the Contracts in the name of the City and the City Clerk is directed to affix the seal of the City thereto and attest same. CP0707 ISSU Should City Council approve an Agreement between the University Park Neighborhood Association and the City of Pueblo, authorize the president of City Council to execute same and budget and appropriate the funds received in the amount of $50,000 relating to the Jerry Murphy Streetscape Project? RECOMMENDATION Adoption of Ordinance BACKGROUND The University Park Neighborhood Association has spearheaded the enhancement of Jerry Murphy Boulevard in the University Park Subdivision. The Phase One Streetscape was completed in 2000 and consisted of landscaping, fencing and decorative planters along the east side of Jerry Murphy Blvd between Bluestem Blvd. and Candy Tuft Blvd. The goal of the project is to continue the streetscape improvements by developing a landscaped median as a gateway to the University Park Subdivision on Jerry Murphy Blvd. The University Park Neighborhood Association is entering into an Agreement with the City of Pueblo which will make available by the Association $50,000 for the construction of the project; make available by the City $150,000 for construction of the project; the City with input from the Association will undertake and complete construction of the project; and the Association will undertake and be responsible for maintenance and replacement of Project landscaping. City will be responsible to repair physical improvements such concrete curb and gutter and splashguard. The City's Parks Department will repair irrigation and pay for water. The plans are being developed by the City for an estimated construction bid date of mid -April with construction to start by June. The project will consist of color concrete splashguards, xeriscape landscaping, irrigation, trees, shrubs, perennials beds and decorative gravel. FINANCIAL IMPACT Funds for the project in the amount of $50,000 from the University Park Neighborhood Association are hereby budgeted and appropriated into project CP0707, Jerry Murphy Streetscape Project. The total budget for said project is hereby increased to a total of $200,000. AGREEMENT This Agreement entered into as of April 9, 2007, by and between the City of Pueblo, a municipal corporation ( "City ") and the University Park Neighborhood Association ( "Association "), Witnesseth Whereas, Association has committed to raise $50,000.00 through fund raising and donations for the Jerry Murphy Streetscape Project described in the attached Exhibit "A" ( "Project"), and Whereas, Association has requested the City to make available $150,000.00 for the Project and to construct the Project which the City is willing to do upon the terms and conditions set forth herein. Now therefore, in consideration of the foregoing and mutual covenants contained herein, City and Association agree as follows: 1. Association will make available $50,000.00 for the Project and deposit said sum with the City's Director of Finance upon execution of this Agreement. 2. City will make available $150,000.00 for the Project, which sum has been appropriated and budgeted in City's 2007 budget. City shall have no additional or future financial obligation with respect to the initial construction of the Project. 3. City, with input from Association, will undertake and complete the construction of the Project and expend City's $150,000.00 and Association's $50,000.00 therefor. 4. Association will undertake and be responsible for maintenance and replacement of Project landscaping initially installed by the City. 5. City will be responsible to repair physical improvements such as concrete curb and gutter, splashguard, and irrigation systems. City will also be responsible for water charges. 6. This Agreement shall be binding upon and inure to the benefit of City and Association and their respective successors and assigns. Executed in Pueblo, Colorado the day and year first above written.
