HomeMy WebLinkAbout07575ORDINANCE NO. 7575 AN ORDINANCE CHANGING ZONING RESTRICTIONS FROM 1 -2 TO B -4 COVERING A PARCEL OF LAND COMMONLY KNOWN AS 824 WEST 4 STREET BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The zoning restrictions covering the following described property be changed from 1 -2, Light Industrial District to B -4, Regional Business District, and upon passage of this ordinance, zoning restrictions affecting B -4, Regional Business District, shall apply to said property: Parcel VI (Assessor's Parcel #536200008) That part of the Northwest Ya of Section 36, Township 20 South, Range 65 West of the 6th Principal Meridian, County of the Pueblo, State of Colorado, described as follows: Beginning at a Point on the South Line of West Fourth Street (as Originally Located) 560 Feet West of the Northwest Corner of Lot 1, Block 3 of Thatcher and Gast's Subdivision, County of Pueblo, State of Colorado, according to the Recorded Plat thereof, Filed for Record December 20, 1890; Thence South and at Right Angles with said Fourth Street, 100 Feet; thence West and Parallel with said Fourth Street, 150 Feet; thence North at Right Angles with said Fourth Street, 100 Feet to a Point in the South Line of said Fourth Street; thence East along the South Line of said Fourth Street, 150 Feet to the Point of Beginning. Excepting thereform the Property Rights included therein previously Conveyed to the Department of Highways by Warranty Deed Recorded in Book 1318 at Page 78, of the Records of the Clerk and Recorder of Pueblo County, Colorado. And that Part of the Northwest Ya of Section 36, Township 20 South, Range 65 West of the 6th Principal Meridian, County of Pueblo, State of Colorado, Bounded and described as follows: Beginning at a Point which is 100 Feet South of a Point on the South Line of West Fourth Street (As Originally Located), which Latter Point is 560 Feet West of the Northwest Corner of Lot 1, Block 3 of said Thatcher and Gast's Subdivision, County of Pueblo, State of Colorado, According to the Recorded Plat Thereof, said Point of Beginning being measured South 100 Feet at Right Angles to said South Line of said West Fourth Street. Thence continuing South 120.75 Feet to a Point; thence North 51 Degrees 10 Minutes West 192.56 Feet to a Point; thence East and Parallel to the South Line of said West Fourth Street 150 Feet to the Point of Beginning (The North Line of this Tract Being Identical with the South Line of Tract Previously Described and Conveyed in this Deed). Parcel VII (No Assessor's Number) Together with an Easement to use as a Roadway, the following described Adjacent Tract of Land, 30 Feet in width, to -wit: Beginning at a Point on the South Line of West Fourth Street (as Originally Located) 560 Feet West of the Northwest Corner of Lot 1, Block 3 of said Thatcher and Gast's Subdivision, County of Pueblo, State of Colorado, according to the Recorded Plat thereof: Thence South 225 Feet, more or less, to the North Line of the existing East -West Driveway and Railroad Right of Way; thence East 30 Feet; thence North 225 Feet, more or less, to the South Line of said West Fourth Street; thence West 30 Feet along the South Line of said West Fourth Street to the Point of Beginning. Parcel VIII (Assessor's Parcel #536200043) All that Part of the North Y of the Northwest Ya of Section 36, Township 20 South, Range 65 West of the 6th Principal Meridian, County of Pueblo, State of Colorado, described as follows: Commencing at a Point on the South Line of West Fourth Street, which is 130 Feet West of the Northwest Corner of Lot 1, Block 3 in Thatcher and Gast's Subdivision, County of Pueblo, State of Colorado, according to the Recorded Plat Thereof; thence West a Distance of 400 Feet along the South Line of West Fourth Street to a Point; thence South 225 Feet; thence East Parallel to the First Course 400 Feet; thence North and Parallel to the Second Course 225 Feet to the Point of Beginning. Excepting therefrom that Portion thereof Conveyed to the Department of Highways in Deed Recorded February 11, 1957 in Book 1320 at Page 279. and more commonly known as: 824 West 4th Street. SECTION 2. This ordinance shall become effective immediately upon final passage and approval. RECOMMENDATION The Planning and Zoning Commission, meeting, voted 5 -0 to recommend approval. at their February 14, 2007 regular BACKGROUND The current use of land is for an automobile repair shop. The applicant is requesting a Zoning Map Amendment to facilitate the development of commercial and professional office uses. The applicant proposes to demolish the existing shop to construct a commercial structure to house future businesses; the approximate date of completion has not been identified. FINANCIAL IMPACT None.
