AN ORDINANCE CHANGING ZONING RESTRICTIONS FROM 1 -2 to B -4 COVERING A PARCEL
OF LAND COMMONLY KNOWN AS STATE LAND BOARD PROPERTY SOUTH OF WEST 2 ND
STREET AND WEST OF GREENWOOD STREET
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The zoning restrictions covering the following described property be changed from I -2, Light
Industrial District to B -4, Regional Business District, and upon passage of this ordinance,
zoning restrictions affecting B -4, Regional Business District, shall apply to said property:
A parcel of land located in a portion of Block 14 in the Map of State Addition to
Pueblo, according to the recorded plat thereof as filed for record January 28, 1878
in the Pueblo County records and being more particularly described as follows:
Per Certificate of Abandonment in Book 2676 at Page 140; All of Block 14, State
Addition, lying within the boundaries of the 200 -foot right of way described as in
document recorded March 29, 1880 in Book 25 at Page 187. Except all of Lot 2 and
that portion of Lots 4 and 5 of said Block 14 in Warranty Deed recorded July 13,
1880 in Book 20 at Page 583.
Per Special Warranty Deed in Book 2702 at Page 930: Lots 2 and all of Lot 4 lying
east of the center line of the Y Track of the Pueblo and Arkansas Valley Railroad
Company; all of Lots 4 and 5 lying west of and within 25 feet from said center line of
the Y Track, Block 14, State Addition.
Also including the north half of vacated alley being south of and adjacent to Lots 1,
2, & 3 of said Block 14, as shown on Ordinance No. 4453 recorded April 5, 1978 in
Book 1929 at Page 124;
Also less and excepting from Block 14 the remainder of the alley, being south of
Lots 4 through 8 and north of Lots 9 through 13 of said Block 14.
Also less and excepting from Block 14 that property described in Warranty Deed to
the Bishop of Pueblo, a Corporation Sole, recorded December 1, 2004 at Reception
N o. 1596608.
Also less and excepting from Block 14 that property described in Patent from State
of Colorado to James Robinson recorded July 9, 1890 in Book 98 at Page 173.
Also all of the South one half of 2 nd Street adjacent to Lots 1 and 2 and the Easterly
26.1 feet of the South one half of said 2 nd Street adjacent to Lot 3;
Also the West one half of Greenwood Street adjacent to Lot 1;
Also the West one half of Greenwood Street adjacent to the North one half of the
Vacated alley as recorded at Book 1929 at Page 124 in the Pueblo Couny records;
Also the North one half of the alley adjacent to Lot 4;
Also the South one half of the Easterly 42.5 feet of the alley adjacent to Lot 10
Containing 1.16 acres, more or less.
and more commonly known as:
State Land Board property south of West 2 nd Street and west of Greenwood Street.
SECTION 2.
This ordinance shall become effective immediately upon final passage and approval.

ISSUE
Shall City Council approve a request to rezone the property from 1 -2, Light
Industrial District, to B -4, Regional Business District, to create additional
commercially zoned property in the downtown area?
The Planning and Zoning Commission, at their February 14, 2007 regular
meeting, voted 5 -0 to recommend approval.
BACKGROUND
The subject property is a section of vacant, undeveloped land located one block
north of the HARP project, adjacent to both business and light industrial uses.
The applicant proposes rezoning from 1 -2, Light Industrial District to B-4,
Regional Business District. The intention of the rezoning request is to create
additional business zoned property downtown that compliments the HARP
project and the adjacent Catholic Church Pastoral Center. The State Land
Board is in the process of cleaning up old railroad right -of -way parcels in the City.
The Board's plan is to liquidate those properties in order to generate revenue
and assist in the redevelopment of the City's downtown corridor.
FINANCIAL IMPACT
None.
