The zoning restrictions covering the following described property be changed from B -3, Highway and Arterial Business District to BP, Business Park District, and upon passage of this ordinance, zoning restrictions affecting BP, Business Park District, shall apply to said property: Lot 2, Block 2, South Prairie Subdivision, Filing No. 2. and more commonly known as: 29 Hayhurst Avenue. SECTION 2. This ordinance shall become effective immediately upon final passage and approval. PACHECO TITLE AN ORDINANCE CHANGING ZONING RESTRICTIONS FROM B -3 TO BP COVERING A PARCEL OF LAND COMMONLY KNOWN AS 29 HAYHURST AVENUE ISSUE Shall City Council approve a request to rezone the property from B -3, Highway and Arterial Business District, to BP, Business Park District, to allow a light manufacturing use for the production of tortillas and tortilla related goods? RECOMMENDATION The Planning and Zoning Commission, at their January 10, 2007 regular meeting, voted 5 -0 to recommend approval. BACKGROUND The applicant is requesting that the parcel of land, 29 Hayhurst Avenue, be re- zoned from B -3, Highway and Arterial Business District, to BP, Business Park District, which would allow a light manufacturing facility for the production of tortillas and tortilla related goods. The La Tolteca factory is currently located at 230 S. Main Street, which is zoned 1 -2, Light Industrial. La Tolteca employs 11 people and the hours of operation are from 6 a.m. to 6 p.m., three (3) days a week. Most of the clientele is based on special orders that are shipped out once a day, limiting foot traffic. Due to the small scope of manufacturing no negative impacts have been identified or reported at their current address. FINANCIAL IMPACT None.
