Uses by right. 1. Office 2. Residence - commercial, apartments or condominiums. 3. Retail store. 4. Restaurant. SECTION 2 Paragraph b of subsection (12.3) of Section 51 of Chapter 4, Title XVII of the Pueblo Municipal Code is hereby amended to read as follows: b. Uses by right. 1. Hotel 2. Office 2. Residence - commercial, apartments or condominiums. 4. Retail store. 5. Restaurant. SECTION 3 Paragraph b of subsection (12.3.1) of Section 51 of Chapter 4, Title XVII of the Pueblo Municipal Code is hereby amended to read as follows: b. Uses by right. 1. Hotel 2. Office 3. Retail store. 4. Restaurant. SECTION 4 This Ordinance shall become effective upon final passage and approval. PACHECO TITLE AN ORDINANCE AMENDING CHAPTER 4 OF TITLE XII OF THE PUEBLO MUNICIPAL CODE RELATING TO PERMITTED USES BY RIGHT IN HISTORIC ARKANSAS RIVERWALK OF PUEBLO ZONE DISTRICTS (HARP -1, HARP -2, AND HARP -3) ISSUE Should the City Council amend Chapter 4 of Title XII to allow restaurants as uses permitted by right in the HARP -1, HARP -2, and HARP -3 Zone Districts? RECOMMENDATION The Planning and Zoning Commission, at their January 10, 2007 Regular Meeting, voted 5 -0 to recommend approval. BACKGROUND The nature of the proposed text amendment is to allow restaurants as uses permitted by right in the HARP -1, HARP -2, and HARP -3 Zone Districts. Since the outset of the planning of the Historic Arkansas Riverwalk of Pueblo, restaurants were considered an integral land use critical to the success of the pedestrian oriented facility. It appears that the initial enabling legislation creating the HARP -1, HARP -2 and HARP -3 Zone Districts erroneously omitted restaurants as a permitted land use. FINANCIAL IMPACT None
