HomeMy WebLinkAbout07564ORDINANCE NO. 7564 AN ORDINANCE AMENDING CHAPTER 1, TITLE IV, OF THE PUEBLO MUNICIPAL CODE RELATING TO INSURANCE REQUIREMENTS AND AMENDING CERTAIN PROVISIONS THEREOF BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO that: (Brackets indicate matter to be deleted; underscoring indicates matter to be added.) SECTION 1. Subsection (a) of Section 17, Chapter 1, Title IV, of the Pueblo Municipal Code is amended and deleted as follows: (a) Before any license or registration shall be issued to engage in the construction business or to perform construction work, an applicant shall file with the Building Official a certificate of Commercial General Liability insurance with personal injury and property damage limits at a combined single limit of not less than two hundred fifty thousand dollars ($250,000) per occurrence and five hundred thousand dollars ($500,000) aggregate. Products and completed operations are not required to be part of this policy. In addition, before any such license or registration is issued, the applicant shall file proof that the applicant has obtained Workers' Compensation Insurance as required by and in accordance with the laws of the State. SECTION 2. Nonliability. The adoption of this Ordinance shall not create any duty to any person, firm, corporation, or other entity with regard to the enforcement or nonenforcement of this Ordinance. No person, firm, corporation, or other entity shall have any private right of action, claim or civil liability remedy against the City of Pueblo or the Pueblo Regional Building Department, or their officers, employees or agents, for any damage arising out of or in any way connected with the adoption, enforcement, or nonenforcement of this Ordinance. Nothing in this Ordinance shall be construed to create any liability, or to waive any of the immunities, limitations on liability, or other provisions of the Governmental Immunity Act, Section 24 -10 -101, et seq., C.R.S., or to waive any immunities or limitations on liability otherwise available to the City of Pueblo or the Pueblo Regional Building Department, or their officers, employees or agents. SECTION 3. If any part, section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this Ordinance. SECTION 4. This Ordinance shall become effective immediately upon final passage and approval. RECOMMENDATION The proposed Ordinance should be approved. BACKGROUND Pueblo Regional Building Department's Commission has requested removal of Completed Operations Insurance from the required Commercial General Liability Insurance. The Pueblo Association of Home Builders and the Pueblo General Contractors Association feel this would be beneficial to all new home buyers due to the increased cost of coverage over the past few years. The Pueblo Regional Building Department's Commission and Building Board have approved this removal of Completed Operations Insurance and ask for consideration. FINANCIAL IMPACT None.
