AN ORDINANCE AMENDING CHAPTER 4, TITLE IV, OF THE PUEBLO MUNICIPAL CODE
RELATING TO THE UNIFORM PLUMBING CODE AND AMENDING CERTAIN PROVISIONS
THEREOF
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO that: (Brackets indicate matter to
be deleted; underscoring indicates matter to be added.)
SECTION 1.
Subsections (1) through (bb) of Section 2 of Chapter 4, Title IV, of the Pueblo Municipal
Code are amended and deleted as follows:
[(I) Section 413.3 of the U.P.C. entitled "Separate Facilities" is amended to read as follows:
"1. Residential installations.
"2. A single restroom may be provided for both sexes and service sinks may be eliminated
for the following:
"a. Mercantile Occupancies of two thousand (2,000) square feet or fewer and usable
by both the public and employees.
"b. Office, Medical and Dental clinics of one thousand (1,000) square feet or fewer
and usable by both the public and employees."
(m) Section 413.4 of the U.P.C. entitled "Fixture Requirements for Special Occupancies" is
deleted.
(n) Section 413.5 of the U.P.C. entitled "Facilities in Mercantile and Business Occupancies
Serving Customers" is deleted.
(o) Section 413.6 of the U.P.C. entitled "Food Service Establishments" is deleted.]
[(p)] (1) Section 415.1 of the U.P.C. is amended to read as follows:
"A removable panel of sufficient size shall be provided to access the pump, but in no
case less than a fourteen (14) inch by fourteen (14) inch opening with at least eighteen (18)
inches clear space in front of the access opening."
[(q)] (m) Table 4 -1 of the U.P.C. entitled "Minimum Plumbing Facilities" is amended to read
as follows:
"Each building shall be provided with sanitary facilities, including provisions for handicap
accessibility in accordance with Chapter 11 of the 2003 International Building Code and the
1998 ICC /ANSI A117.1 Accessible and Usable Buildings and Facilities Standards.
"The total occupant load shall be determined by using Table 10 -A "Occupant Load Factor"
of the2003 International Building Code and is assumed to be based on fifty percent (50 %)
male and fifty percent (50 %) female.
"EXCEPTION: Where circumstances dictate a different ratio is needed, the adjustment shall
be approved by the Building Official."
[(r)] (n) Section 601.0 of the U.P.C. entitled "Running Water Required" is amended by the
addition of a new Section to read as follows:
"Section 601.4 In dwellings and buildings intended for human occupancy, hot water shall be
supplied to all plumbing fixtures and equipment used for bathing, washing, culinary
purposes, cleaning of laundry or building maintenance."
[(s)] (o) Section 604.1 of the U.P.C. is amended by the addition of the following exception to
read as follows:
"EXCEPTION: All new or replaced water service piping fewer than two (2) inches (51 mm)
from the main to the meter shall be no lighter than Type L Copper or PEX, PE- AL -PE, AND
PEX -AL -PEX pipe. A blue 14 gauge tracer wire shall be installed with all non - metallic water
services. All service piping two (2) inches (51 mm) or larger shall be Type K Copper, Class
50 or Ductile Iron, Class 150 Asbestos Cement, or PVC American Water Works Association
approved pressure pipe or other approved material. Water service piping shall be installed
to a minimum of forty -eight (48) inches (1219.2 mm) depth from the top of the pipe."
[(t)] (p) Section 605.3. of the U.P.C., the first sentence is amended to read as follows:
"A fullway valve controlling all outlets shall be installed inside a building or structure on the
water service line in a readily accessible area."
[(u)] (q) Section 707.10 of the U.P.C. is amended to read as follows:
"Each cleanout in piping two (2) inches (51 mm) or less in size shall be so installed so there
is a clearance of not less than twelve (12) inches (305 mm) in front of the cleanout.
Cleanouts in piping larger than two (2) inches (51 mm) shall have a clearance of not less
than eighteen (18) inches (457 mm) in front of the cleanout."
[(v)] (r) Section 713.0 of the U.P.C. entitled "Building Sewers" is amended by the addition of
a new Section to read as follows:
"Section 713.7 "Private Sewer (Mains)" as defined in Chapter 2 of this Code, connecting to
a public sewer system shall be installed according to the specifications and requirements of
the City Department of Public Works. Plans and permits shall be as required by Chapter 1
of the U.P.C. Private sewer inspections shall be made by the City Department of Public
Works or the Pueblo Regional Building Department."
[(w)] (s) Subsection 408.6 of the U.P.C. entitled "Setting" is amended by the addition of a
paragraph to read as follows:
"Where more than one (1) water closet or water closets and urinals are installed in a room,
they shall be separated by an approved partition wall. Urinals set next to each other or
another fixture shall have an approved splash guard."
[(x)] (t) Table 4 -1 of the U.P.C. is amended by the addition of the following provisions, the
addition of footnote 15, 16 and 17, and the amendments to footnote 14, as provided below:

14. The total number of water closets for females shall be at least equal to the total number of
water closets and urinals required for males. This requirement shall not apply to retail or
wholesale stores.
15. For smaller type public and professional offices such as banks, dental offices, law offices,
real estate offices, architectural offices, engineering offices, and similar uses. A public area
in these offices shall use the requirements for retail or wholesale stores.
16. Where more than one (1) water closet or water closets and urinals are installed in a room
they shall be separated by an approved partition wall. Urinals set next to each other or
another fixture shall have an approved splash guard.
17. In each bathroom or toilet room, urinals shall not be substituted for more than 67% of the
required water closets.
[(y)] (u) Table 4 -1 Footnote 3 of U.P.C. is amended to read as follows:
"Drinking fountains, mop sinks or service sinks shall not be installed in restrooms. Service
sinks shall be required on each floor where toilet facilities are required."
[(z)] (v) Section 603.0 of the U.P.C. entitled "Cross- Connection Control' is amended by the
following addition:
"All new or remodeled public buildings shall have a reduced pressure -type backflow
preventer installed on the water service supplying such buildings or any portion thereof."
[(aa)] (w) Subsection 604.2, the Exceptions is amended to read as follows:
"Type "M" copper tubing may be used for water piping when piping is above ground in or on
a building."
[(bb)] (x) Subsection 1501.1 entitled "Applicability" is amended to read as follows:
"All piping penetrations of required fire - resistance rated walls, partitions, floor, floor /ceiling
assemblies, roof /ceiling assemblies or shaft enclosures shall be protected in accordance
with the requirements of the 2003 International Building Code, Chapter 6 and this Chapter."
SECTION 2.
Nonliability. The adoption of this Ordinance shall not create any duty to any person, firm,
corporation, or other entity with regard to the enforcement or nonenforcement of this Ordinance.
No person, firm, corporation, or other entity shall have any private right of action, claim or civil
liability remedy against the City of Pueblo or the Pueblo Regional Building Department, or their
officers, employees or agents, for any damage arising out of or in any way connected with the
adoption, enforcement, or nonenforcement of this Ordinance. Nothing in this Ordinance shall be
construed to create any liability, or to waive any of the immunities, limitations on liability, or other
provisions of the Governmental Immunity Act, Section 24 -10 -101, et seq., C.R.S., or to waive any
immunities or limitations on liability otherwise available to the City of Pueblo or the Pueblo
Regional Building Department, or their officers, employees or agents.
SECTION 3.
If any part, section, subsection, sentence, clause or phrase of this Ordinance is for any
reason held to be invalid, such decision shall not affect the validity of the remaining portions of this
Ordinance.
SECTION 4.
This Ordinance shall become effective immediately upon final passage and approval.

ISSUE
Should the proposed Ordinance be approved?
RECOMMENDATION
The proposed Ordinance should be approved.
BACKGROUND
These changes will eliminate any confusion for the design community when submitting plans for
future building projects and bring this Department into line with the code as published. The
Pueblo Regional Building Department's Plumbing Board has approved these amendments and
asks for consideration.

None.
