HomeMy WebLinkAbout07521Reception 1729320 06/07/2007 ORDINANCE NO. 7521 AN ORDINANCE VACATING CERTAIN STREETS, PUBLIC UTILITY AND DRAINAGE EASEMENTS WITHIN FOUNTAIN PARK COMMERCIAL CENTER SUBDIVISION BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: SECTION 1. Certain streets, public utility and drainage easements within Fountain Park Commercial Center Subdivision according to the recorded plat thereof filed for record May 14, 1975 in Book 1813 at Page 533 -534 in the records of the Pueblo County Clerk and Recorder, and more particularly described as follows: All of Commercial Drive within said Fountain Park Commercial Center Subdivision; -And- All of Warehouse Drive, Dillon Drive (formerly known as Warehouse Drive) and Storage Drive within said Fountain Park Commercial Center Subdivision, lying north of the following described line: BEGINNING at the NE corner of Lot 10, Block 3, Fountain Park Commercial Center according to the recorded plat thereof, filed for record May 14, 1975 in Book 1813 at Page 533 -534 in the records of the Pueblo County Clerk and Recorder; thence N 89 0 07'37 "E, a distance of 86.89 feet to the NW comer of Lot 4, Block 1 of said Fountain Park Commercial Center being the POINT OF TERMINUS. ffm All the Public Utility and Drainage Easements lying within Lots 5 through 9 and 11 through 20, Block 3 and all of the Public Utility and Drainage Easements lying within Block 2, of said Fountain Park Commercial Center Subdivision. are hereby vacated. PACHECO TITLE AN ORDINANCE VACATING CERTAIN STREETS, PUBLIC UTILITY AND DRAINAGE EASEMENTS WITHIN FOUNTAIN PARK COMMERCIAL CENTER SUBDIVISION 0 Shall City Council approve the vacation of all rights -of -way and easements, as part of the Eaglecross Business Subdivision, no longer necessary to serve the development? juriE '-1, 2Dv4, The Planning and Zoning Commission, at their regular meeting, voted 5-0 to recommend approval. 13ACKGROUND 1,000 feet north of the intersection of Dillon Drive and Eagleridge Boulevard, east of Interstate 25. As part of the Eaglecross Business Subdivision proposal, the applicant intends to vacate all rights -of -way and easements no longer necessary to serve the development. In the Subdivision Review Committee memo dated September 14, 2006, it was their recommendation that the plat be approved if the following deficiencies were addressed: 1. Acceptable secondary access does not exist to provide necessary emergency access to all lots within the subdivision. 2. All property included within this subdivision will be required to contribute a proportionate financial contribution to fund the public improvements to the Dillon Drive /Platteville split- diamond interchange on 1 -25. Acceptable secondary access will be provided. The subdivision ordinance requires the property owner to enter into an agreement with the City to provide for the property owner's proportionate financial contribution to fund the public improvements to the Dillon Drive /Platteville split- diamond interchange on Interstate 25. FINANCIAL IMPACT None.
