HomeMy WebLinkAbout10767 City Clerk's Office Item # R11 Background Paper for Proposed Ordinance COUNCIL MEETING DATE: August 26, 2024 TO: President Mark Aliff and Members of City Council CC: Mayor Heather Graham VIA: Marisa Stoller, City Clerk FROM: Steven Meier, Director of Parks and Recreation SUBJECT: AN ORDINANCE APPROVING AND AUTHORIZING THE MAYOR TO SIGN A FACILITY USE AGREEMENT BETWEEN THE CITY OF PUEBLO, A COLORADO MUNICIPAL CORPORATION, AND THE PUEBLO CITY-COUNTY LIBRARY DISTRICT, A NONPROFIT ENTITY, FOR USE OF CERTAIN PARK PREMISES SUMMARY: This Ordinance approves and authorizes the Mayor to sign a Facility Use Agreement between the City of Pueblo and the Pueblo City-County Library District for use of the El Centro del Quinto Sol Community Recreation Center to provide library programs during renovations of the Lucero Library branch. PREVIOUS COUNCIL ACTION: Not applicable to this Ordinance. BACKGROUND: On April 1, 2024, City staff met with Pueblo City-County Library District representatives to discuss the Library using some space at the El Centro del Quinto Sol Community Recreation Center during renovation of the Lucero branch beginning in July 2024. The construction is scheduled to last ten to twelve months. FINANCIAL IMPLICATIONS: Not applicable to this Ordinance. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Ordinance. STAKEHOLDER PROCESS: Not applicable to this Ordinance. ALTERNATIVES: Should the Council choose not to approve this agreement, the Library will have to determine an alternative for a temporary library location during renovation. RECOMMENDATION: Approval of the Ordinance. ATTACHMENTS: 1. AGREEMENT - PCCLD - CITY for Use of El Centro del Quinto Sol - Facility Use Agreement - 2024-2025 ORDINANCE NO. 10767 AN ORDINANCE APPROVING AND AUTHORIZING THE MAYOR TO SIGN A FACILITY USE AGREEMENT BETWEEN THE CITY OF PUEBLO, A COLORADO MUNICIPAL CORPORATION, AND THE PUEBLO CITY-COUNTY LIBRARY DISTRICT, A NONPROFIT ENTITY, FOR USE OF CERTAIN PARK PREMISES BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Mayor is hereby authorized to execute the Agreement in the name and on behalf of the City of Pueblo, where the Mayor may execute the Agreement by electronic signature and such electronic signature shall be attributable to the Mayor and the City of Pueblo. SECTION 2. The officers and staff of the City are authorized to perform any and all acts consistent with the intent of this Ordinance to implement the policies and procedures described herein. SECTION 3. This Ordinance shall become effective on the date of final action by the Mayor and City Council.
