HomeMy WebLinkAbout10764 City Clerk's Office Item # R8 Background Paper for Proposed Ordinance COUNCIL MEETING DATE: August 26, 2024 TO: President Mark Aliff and Members of City Council CC: Mayor Heather Graham VIA: Marisa Stoller, City Clerk FROM: Andrew Hayes, Public Works Director SUBJECT: AN ORDINANCE APPROVING A MAINTENANCE IGA BETWEEN THE CITY OF PUEBLO, A COLORADO MUNICIPAL CORPORATION; PUEBLO COUNTY, A POLITICAL SUBDIVISION OF THE STATE OF COLORADO; AND THE STATE OF COLORADO BY AND THROUGH THE COLORADO DEPARTMENT OF TRANSPORTATION RELATED TO THE MAINTENANCE OF INSTALLED ROADWAY IMPROVEMENTS ALONG THE MEDAL OF HONOR BOULEVARD CORRIDOR, AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT SUMMARY: The Ordinance will approve an Intergovernmental Agreement between the City, Pueblo County, and the Colorado Department of Transportation (CDOT) which outlines maintenance responsibilities of each of the parties for installed roadway improvements in the vicinity of Pueblo Boulevard (CO-45) and Medal of Honor Boulevard. The Ordinance also authorizes the Mayor to execute and deliver the agreement on behalf of the City. PREVIOUS COUNCIL ACTION: On June 13, 2024, City Council voted to approve Ordinance No. 10726 which approved an Easement Agreement between the City and the County related to the construction, operation, and maintenance of Medal of Honor Boulevard through City-owned land outside of the City, generally west of the new County Detention Facility. BACKGROUND: The City of Pueblo, Pueblo County, and CDOT have developed this agreement to clarify responsibilities associated with the operation and maintenance of roadway improvements on Medal of Honor Boulevard in the vicinity of Pueblo Boulevard (CO- 45). FINANCIAL IMPLICATIONS: The segment of Medal of Honor Boulevard located within City of Pueblo is a City roadway and the City will have ongoing maintenance obligations for certain public improvements as outlined within the subject agreement. However, CDOT and Pueblo County have also undertaken obligations for some of the existing and new improvements. Pueblo County is responsible for managing the installation of the work under their project to construct the Medal of Honor roadway. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Ordinance. STAKEHOLDER PROCESS: None. ALTERNATIVES: Failure to approve this Ordinance will prevent the City from being a party to the proposed agreement and place additional burden on the City for ongoing maintenance responsibility of improvements that would otherwise be the responsibility of Pueblo County and/or CDOT. RECOMMENDATION: Approval of the Ordinance. ATTACHMENTS: 1. The Intergovernmental Agreement between the City of Pueblo, a Colorado Municipal Corporation; Pueblo County, a political subdivision of the State of Colorado; and the State of Colorado, by and through the Colorado Department of Transportation; a copy of which is attached hereto, having been approved as to form by the City Attorney, are hereby approved. SECTION 2. The Mayor is authorized to execute and deliver the Intergovernmental Agreement in the name of the City of Pueblo, and the City Clerk is directed to affix the seal of the City thereto and attest same. SECTION 3. The officers of the City of Pueblo are authorized to perform any and all acts consistent with this Ordinance to implement the policies and procedures described herein. SECTION 4. This Ordinance shall become effective on the date of final action by the Mayor and City Council.
