HomeMy WebLinkAbout10759 City Clerk's Office Item # R3 Background Paper for Proposed Ordinance COUNCIL MEETING DATE: August 26, 2024 TO: President Mark Aliff and Members of City Council CC: Mayor Heather Graham VIA: Marisa Stoller, City Clerk FROM: Greg Pedroza, Director Aviation SUBJECT: AN ORDINANCE APPROVING AND ACCEPTING AIRPORT IMPROVEMENT PROGRAM (AIP) GRANT AGREEMENT NO. 3-08- 0046-050-2024 FROM THE UNITED STATES OF AMERICA ACTING THROUGH THE FEDERAL AVIATION ADMINISTRATION FOR FUNDS IN THE AMOUNT OF $253,073 FOR COSTS RELATED TO THE REHABILITATION OF EAST (NORTH) APRON (DESIGN) AT THE PUEBLO MEMORIAL AIRPORT, BUDGETING AND APPROPRIATING $253,073 TO PROJECT AP2401 EAST APRON (N) TAXILANE REHAB, AND AUTHORIZING THE MAYOR TO EXECUTE SAME SUMMARY: This Ordinance will approve and accept an Airport Improvement Program (AIP) grant agreement from the United States of America acting through the Federal Aviation Administration (FAA) to provide funding for costs related to the rehabilitation of the East (North) Apron, budgeting and appropriating funds to Project No. AP2401 East Apron (N) Taxilane Rehab. PREVIOUS COUNCIL ACTION: Ordinance 10728, established Project AP2401, accepted CDOT Grant # 24-PUB-01, and budget and appropriated CDOT and local matching funds. BACKGROUND: The Colorado Department of Transportation (CDOT) Aeronautics Division conducted a pavement condition assessment of this portion of the East apron, and it was determined that the pavement needs rehabilitation. This project is on the Capital Improvement Plan schedule for 2025, approved by both the FAA and CDOT for Entitlement Fund use. FINANCIAL IMPLICATIONS: The total design project cost is $259,893.54. The FAA AIP Grant is (95%) of the total project costs not to exceed $253,073. The CDOT approved grant amount (2.5%) of the total design project costs not to exceed $6,546.00 which was budgeted and $6,548.00, was transferred, and budgeted and appropriated from the Airport Improvement Trust Fund in a previous ordinance. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Ordinance. STAKEHOLDER PROCESS: Not applicable to this Ordinance. ALTERNATIVES: If this Ordinance is not approved, the grant will not be accepted from the federal government and the project will not occur. RECOMMENDATION: Approve the Ordinance. ATTACHMENTS: 1. PUB-NMG-3-08-0046-050-2024-DRAFT Grant Agreement (No Watermark) ORDINANCE NO. 10759 AN ORDINANCE APPROVING AND ACCEPTING AIRPORT IMPROVEMENT PROGRAM (AIP) GRANT AGREEMENT NO. 3- 08-0046-050-2024 FROM THE UNITED STATES OF AMERICA ACTING THROUGH THE FEDERAL AVIATION ADMINISTRATION FOR FUNDS IN THE AMOUNT OF $253,073 FOR COSTS RELATED TO THE REHABILITATION OF EAST (NORTH) APRON (DESIGN) AT THE PUEBLO MEMORIAL AIRPORT, BUDGETING AND APPROPRIATING $253,073 TO PROJECT AP2401 EAST APRON (N) TAXILANE REHAB, AND AUTHORIZING THE MAYOR TO EXECUTE SAME WHEREAS, the City of Pueblo has received a Grant Agreement from the Federal Aviation Administration (FAA) for costs related to the Rehabilitation of East (North) Apron (Design); NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Federal Aviation Administration Grant Agreement No. 3-08-0046-050- between the City of Pueblo, a Municipal Corporation, and the United States of America through the costs related to the Rehabilitation of East (North) Apron (Design), after having been approved as to form by the City Attorney, is here by accepted and approved. SECTION 2. The Mayor is hereby authorized to execute the Grant Agreement in the name and on behalf of the City of Pueblo, where the Mayor may execute the Grant Agreement by electronic signature and such electronic signature shall be attributable to the Mayor and the City of Pueblo. SECTION 3. Funds in the amount of $253,073.00 shall be accepted pursuant to the Grant Agreement and budgeted and appropriated to Project No. AP2401 East Apron (N) Taxilane Rehab. SECTION 4. Pursuant to the Grant Agreement, the FAA may make unilateral amendments to the grant terms and its obligation thereunder, including the increasing or decreasing of its grant obligation. In accordance therewith, such amendments shall be effective without the need for an additional ordinance or other action by City Council. Should the FAA increase the maximum grant obligation, said funds shall be automatically budgeted and appropriated to Project No. AP2401 East Apron (N) Taxilane Rehab without the need for further action. SECTION 5. The officers and staff of the City are authorized to perform any and all acts consistent ith this Ordinance to implement the policies and procedures described herein. SECTION 6. This Ordinance shall become effective on the date of final action by the Mayor and City Council. Action by City Council: Introduced and initial adoption of Ordinance by City Council on August 12, 2024.
