AN ORDINANCE REPEALING ORDINANCE 7327, AN ORDINANCE APPROVING THE PUEBLO
METRO - CENTER MALL, FILING NO. 4, A SPECIAL AREA PLAN AMENDED JUNE 27, 2005
WHEREAS, The City Council approved Ordinance 7327, An Ordinance Approving the
Pueblo Metro - Center Mall Filing No. 4, A Special Area Plan Amended on June 27, 2005. C &M
Consulting, LLC have appealed to repeal Ordinance 7327 on behalf of the property owner, Dr. Eric
Richardson. The Ordinance allowed the owner of the property to rearrange the property
boundaries (Lots 2 & 3 Block 2) and create one large parcel in order to construct a commercial
office and site amenities. The developer no longer intends to construct the previously proposed
commercial building and the property owner would like to repeal the Ordinance that would have
allowed the two lots to be combined into one parcel.
WHEREAS, The Planning and Zoning Commission has determined that A Rearrangement
of Property Boundaries never took place and the platted subdivision has not been amended, and
WHEREAS, the Planning and Zoning Commission has recommended that Ordinance 7327,
An Ordinance Approving the Pueblo Metro - Center Mall Filing No. 4, A Special Area Plan Amended
June 27, 2005 be repealed.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
Ordinance 7327, An Ordinance Approving the Pueblo Metro - Center Mall Filing No. 4, A
Special Area Plan Amended June 27, 2005 be repealed.
SECTION 2.
This Ordinance shall become effective immediately upon final passage and approval.

ISSUE
Shall City Council repeal Ordinance 7327 that would have allowed owners to rearrange
the property boundaries and create one large parcel for commercial development?
RECOMMENDATION
The Planning and Zoning Commission, at their August 9, 2006 regular meeting, voted
6-0 to recommend approval.
BACKGROUND
This property is generally located south of State Highway 78, west of Pueblo
Boulevard, north of Surfwood Lane adjoining the west side of Columbia Drive.
The City Council approved Ordinance 7327, An Ordinance Approving the Pueblo
Metro - Center Mall Filing No. 4, A Special Area Plan Amended on June 27, 2005. The
ordinance allowed the owners of the property to rearrange the property boundaries
(Lots 2 & 3 Block 2) and create one large parcel in order to construct a commercial
office and site amenities. A Rearrangement of Property Boundaries never took place
and the platted subdivision has not been amended. The commercial developer no
longer intends to construct the previously proposed commercial building and would like
to repeal the ordinance that would have allowed the two lots to be combined into one
parcel.
