AN ORDINANCE CHANGING ZONING RESTRICTIONS FROM R -2 TO PUD COVERING A
PARCEL OF LAND COMMONLY KNOWN AS THE LA BELLA PIAZZA PROPERTY
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The zoning restrictions covering the following described property be changed from R -2,
Single - Family Residential District, to PUD, Planned Unit Development, and upon passage of this
ordinance, zoning restrictions affecting Planned Unit Development shall apply to said property:
Parcel A:
A Parcel of land in the SE 1/4 of Section 15, Township 21 South, Range 65 West of
the 6th Principal Meridian more particularly described as follows:
Beginning at a point on the NE corner of Fairfield 1st, thence Southeasterly parallel
to Hoffman Avenue, 280 feet; thence Southwesterly 200 feet parallel to the South
line of Fairfield 1st, thence Northwesterly parallel to Hoffman Avenue to the
Southeast line of Fairfield 1st, 280 feet; thence Northeasterly 200 feet to the Point
of Beginning.
Parcel B:
A Parcel of land in the SE 1/4 of Section 15, Township 21 South, Range 65 West of
the 6th Principal Meridian more particularly described as follows:
Beginning at a point on the East line of Section 15, 770 feet South of the NE comer
of the SE 1/4 of Section 15; thence N60 °05'W parallel to and 10 feet distant
normally South of the centerline of Hoffman Avenue extended Southeasterly 840
feet, more or less to a point on the East line of said Section 15; thence North along
said East line 248.39 feet more or less to the Point of Beginning.
Excepting the Northerly 50 feet for Road and except the Westerly 280 feet and
except tract 175 feet x 150 feet sold.

along the Southerly right -of -way line of Pueblo Boulevard 175 feet; thence South

SECTION 2.
Upon the recommendation by the Planning and Zoning Commission, and in order to
mitigate any adverse effect on surrounding property, this Ordinance is approved with the following
conditions:
(1) On the Development Plan, under the table listed Land Use Requirements, change the
principal structure setbacks to be consistent with the Development Guide.
(2) Place Contractor's office and shop, limited, as a Not Permitted land use in the C3 land use
area.
(3) Fairfield Avenue and the extension or terminus of the right -of -way must
a. Be extended from the present terminus of Fairfield Avenue to connect to Granada
Boulevard; or
b. Terminate Fairfield with a cul -de -sac (public) or hammerhead (private); or
c. Extend an ingress /egress easement into site and incorporate a connection into
parking lot circulation patterns.
SECTION 3.
This ordinance shall become effective immediately upon final passage and approval.

LaBella Piazza Development Guide
I. INTRODUCTION
A. Statement of Purpose
This document shall serve as a guideline for the implementation of design standards for the La
Bella Piazza Commercial Development by providing, in detail, the objectives of the development.
These guidelines will assist in providing a definitive set of objectives and the intended community
design character, whereby any impacts on the surrounding neighborhood will be mitigated.
Project Narrative
La Bella Piazza is a planned commercial district along Pueblo Boulevard and Grenada Street
consisting of approximately 27 acres in south Pueblo, Colorado. The design is intended to create a
sense of community and identity, while employing a transitional land use between an older
residential subdivision and a light-industrial park. The development will be moderate in density.
The design should emphasize family dinning, retail establishments, and community interaction.
The PUD shall enable the developer to illicit input from surrounding neighborhoods in an effort to
minimize any impacts to the surrounding areas.
The PUD development will help to create a positive social environment. Development of this
parcel will help to spur some additional re-development in this area of town. Additionally,
development of this PUD will help to aesthetically enhance the intersection of South Prairie Avenue
and Pueblo Boulevard. The development will help to enhance the transportation infrastructure at
the this intersection with new signals, walkways and pedestrian sidewalks. The neighboring
drainage issue will also be solved as this development will help drain the neighborhood directly to
the west and relieve drainage from both Aster and Fairfield streets.
The development will enable the subject property cleaned with the removal of dead trees and
trash. Once developed, the property will contain large amounts of lush green landscaping as an
aesthetic enhancement as well as an additional buffer to the surrounding neighborhoods. The
overriding architectural features shall reflect a modern Spanish revival theme, according to city
guidelines,with the architecture of Phase I setting the architectural theme for future phases.
It is anticipated that final approvals for the PUD development will be in place by December of 2006
and allow for a first quarter 2007 groundbreaking of Phase 1 (C1, C2). Phase 1 is anticipated to
be complete by June of 2007. Phase two is expected to begin in the second quarter of 2007 and
be completed by fall of 2007.
Directly to the south of this proposed commercial development is a 1,800 acre master-planned
community called SouthPoint. The development currently has single-family dwelling units with
office and industrial uses planned for the near future.

B. Definition—Planned Unit Development Commercial Districts
These definitions are provided for clarification of uses proposed by the Development Guidelines.
Unless otherwise stated herein, all provision of and definitions found in the Pueblo Development
Codes shall apply.

1. Cl means a Limited Commercial land use area containing convenience, commercial,
office, restaurant and financial service land uses
2. C2 means a general retail land use area including building material sales, with outdoor
sales,displays,storage, general retail contained in the form of in-line space in a retail
center.
3. C3 means A mixed Multi-Family and office land use area,whereby freestanding office
uses are limited to less than 40%of the total land area and vertically mixed uses are
encouraged.
4. USBR means a use by special review as processed according to Section 17-5-33 of the
Pueblo Municipal Code.
C. Legislative Intent
It is the intent of this Development Guide to be consistent with and to assist in the implementation
of the City of Pueblo's Zoning Ordinance to:
1. Minimize the burden of traffic on streets and highways
2. Conserve and enhance the value of the land
3. Provide a procedure which can relate the type and layout of the building development to the
particular site
D. Application
These standards shall apply to all property contained within the La Bella Piazza PUD that is shown
on the attached plan. The regulations and requirements shall become the governing standards for
review, approval and modification of all development activities occurring on the site.
Provisions of this guide shall prevail and govern the uses permitted within the La Bella Piazza
PUD; however, this guide shall only supersede the specific zoning regulations of the City when
referenced within the Development Guide and not the City's Zoning Ordinance as amended.
Il. AUTHORITY
A. Authority
The authority of this Development Guide is Chapter 8 of Title XVII of the Pueblo Municipal Code as
amended.
B. Adoption
Reference: Section 17-8-2(c) —Paragraph J of the City of Pueblo Municipal Code
C. Relationship of City Regulations
The provisions of this Development Guide shall prevail and govern development of La Bella Piazza
PUD except where the provisions of the Development Guide do not clearly address a specific
subject,or where there is a conflict. In such a case the provisions of the City of Pueblo Zoning
Ordinance,or any other codes or regulations of the Large Scale Development Standards
(Reference: Sec. 17-4-46 Large-scale development performance standards)for the City of Pueblo
shall prevail where applicable.
D. Enforcement
The provisions of the Development Guide relating to the use of land shall run in favor of the City of
Pueblo and shall be enforceable, at law or in equity, by the City of Pueblo.

111. CONTROL PROVISIONS
A. Control Over Use
After the adoption of this Development Guide by the City Council:
1. Any new building or other structure, and any parcel of land may be used in accordance with
the provisions of this Development Guide and Plan;
2. The use of any existing building, other structure, or parcel of land may not be changed or
extended except for those uses provided for by this Development Guide.
B. Control Over Location and Bulk
After the adoption of this Development Guide by the City Council,the location and bulk of all
buildings and other structures built after the effective date of the Development Guide,shall be in
conformance with:
1. All applicable standards contained within the Development Guide;and
2. Any other applicable standards contained within the City of Pueblo Large Scale Development
Standards.
3. Multi-Family regulations contained in Section 17-4-4 of the Pueblo Municipal Code.
IV. DEVELOPMENT STANDARDS
COMMERCIAL DISTRICTS: Cl —C2—C3
The proposed Commercial Districts are intended to provide small-scale convenience retail and
personal service uses that are pedestrian oriented and neighborhood serving. These commercial
uses will be scaled appropriately to ensure that they are compatible with both existing and planned
neighborhoods.
Sec. 1-10—Description
The Cl area functions to establish an appropriately scaled commercial development edge along
Pueblo Boulevard.
The C2 area is the transitional area in terms of commercial uses along Grenada Boulevard and
south of the Cl area. The Character of this area can be more intensive than that of the Cl area,
however, this area will still integrate itself into a cohesive whole within the La Bella Piazza
development in terms of overall scale and massing.
The C3 area is contained within the southern tip of the development along Grenada Boulevard and
Farabaugh Avenue and is bordered by the C2 area to the north and will also be integrated into a
cohesive whole within La Bella Piazza in terms of overall scale and massing.
Sec. 1-20—Purpose/Intent
1. Provide flexibility of commercial uses that offer convenience to the surrounding residential and
commercial community.
2. Create a quality development to act as a buffer between residential and industrial
neighborhoods.

AN ORDINANCE CHANGING ZONING RESTRICTIONS FROM R -2 TO PUD
COVERING A PARCEL OF LAND COMMONLY KNOWN AS THE LA BELLA PIAZZA
PROPERTY
ISSUE
Shall City Council approve a request to rezone the property from R -2, Single - Family
Residential District to Planned Unit Development District, to develop the 26.94 -acre
property into a commercial shopping center with a mixture of residential and /or office
uses?
RECOMMENDATION
The Planning and Zoning Commission, at their July 12, 2006 regular meeting, voted 5 -0
to recommend approval.
BACKGROUND
The La Bella Piazza property is generally located southwest of the intersection of Pueblo
Boulevard and South Prairie Avenue.
Applicant proposes to rezone the subject 26.94 -acre property from R -2, Single- family
Residential District to PUD, Planned Unit Development Zone District in order to
accommodate a commercial shopping center while providing residential and office land
uses within the same development. As proposed, the PUD provides three (3) land use
areas listing specific permitted uses and standards for each area. Given the fact that a
large format user is planned to occupy one (1) of the future building sites, the PUD
mandates compliance with the requirements of the Large -scale Development Standards
provided in Section 17 -4 -46 of the Pueblo Municipal Code.
