The zoning restrictions covering the following described property be changed from 1 -2, Light Industrial District, to B -3, Highway and Arterial Business District, and upon passage of this ordinance, zoning restrictions affecting B -3, Highway and Arterial Business District, shall apply to said property: North Y of Lot 1 Less The North 10 Feet Thereof Granton, and more commonly known as: 2210 And 2212 East 4th Street, SECTION 2. This ordinance shall become effective immediately upon final passage and approval. PACHECO TITLE AN ORDINANCE CHANGING ZONING RESTRICTIONS FROM 1 -2 TO B -3 COVERING A PARCEL OF LAND COMMONLY KNOWN AS 2210 AND 2212 EAST 4 STREET ISSUE Shall City Council approve a request to rezone the property from 1 -2, Light Industrial District to B -3, Highway and Arterial Business District to accommodate commercial development and expansion of the current building? The Planning and Zoning Commission, at their July 12, 2006 regular meeting, voted 5 -0 to recommend approval. BACKGROUND With this request the applicant proposes to rezone the subject 1.06 -acre property from 1 -2 to B -3. The applicant operates a nonconforming business (liquor store) in an 1 -2 Zone District. The applicant is seeking to conduct a large -scale renovation and expansion of the current building. Since the property is not zoned to allow the use, the applicant cannot obtain a building permit to increase the square footage of the building. FINANCIAL IMPACT None.
