HomeMy WebLinkAbout07492Reception 1814211 08/04/2009 ORDINANCE NO. 7492 AN ORDINANCE APPROVING A SPECIAL AREA PLAN FOR LOTS 6 AND 7, BLOCK 45, STONE AND THATCHER SUBDIVISION WHEREAS, A request for a Special Area Plan for Lots 6 and 7, Block 45, Stone and Thatcher Subdivision has been submitted to the Planning and Zoning Commission for approval pursuant to Section 17 -4 -29 of the Pueblo Municipal Code, and WHEREAS, the Planning and Zoning Commission after a public hearing found and determined the objectives and requirements of said Section 17 -4 -29 can and will be met, and WHEREAS, the Planning and Zoning Commission has recommended the approval of the Special Area Plan for Lots 6 and 7, Block 45, Stone and Thatcher without conditions: NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Special Area Plan for Lots 6 and 7, Block 45, Stone and Thatcher Subdivision, attached hereto, is hereby approved. SECTION 2. This ordinance shall become effective immediately upon final passage and approval. PACHECO TITLE AN ORDINANCE APPROVING A SPECIAL AREA PLAN FOR LOTS 6 AND 7, BLOCK 45, STONE AND THATCHER SUBDIVISION ISSUE Shall City Council approve the Special Area Plan to facilitate the construction of two (2) single - family homes on two (2) legal non - conforming lots in a R-4 Zone District? RECOMMENDATION The Planning and Zoning Commission, at their June 14, 2006 regular meeting, voted 6 -0 to recommend approval. BACKGROUND Property located at 1112 and 1114 Cypress Street. The applicant proposes to create a Special Area Plan that would allow construction of two (2) single family homes on lots that are currently too narrow for the current R -4 Zone District. At 4,305 square feet the applicant currently meets the minimum area for a single family home in an R -4 Zone District (3,000). However, the 35 foot width is below the minimum 50 foot width required in an R -4 Zone District. Other than the minimum lot width deficiency, the proposed buildings will meet all setbacks and lot coverage requirements. FINANCIAL IMPACT None.
