HomeMy WebLinkAbout07490ORDINANCE NO. 7490 AN ORDINANCE CHANGING ZONING RESTRICTIONS FROM B -1, TO B -3, COVERING A PARCEL OF LAND COMMONLY KNOWN AS VAUGHN'S SUBDIVISION BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO. that: SECTION 1. The zoning restrictions covering the following described property be changed from B -1, Neighborhood Business District, to, B -3, Highway and Arterial Business District, and upon passage of this ordinance, zoning restrictions affecting B -3, Highway and Arterial Business District, shall apply to said property: Lots 1 and 2, Block 1, Vaughn's Subdivision and more commonly known as: Vaughn's Subdivision SECTION 2. This ordinance is approved upon the condition that the architecture of buildings erected on the subject property shall comply with Sections 17- 4- 46(e)(2) and 17- 4- 46(e)(3) of the PMC to mitigate the uncontrolled strip commercial development in this area that has a light industrial appearance. SECTION 3. This ordinance shall become effective immediately upon final passage and approval. PACHECO TITLE c1d E 1� AN ORDINANCE CHANGING ZONING RESTRICTIONS FROM B -1, TO B -3, COVERING A PARCEL OF LAND COMMONLY KNOWN AS VAUGHN'S SUBDIVISION ISSUE Shall City Council approve a request to rezone the property from B -1, Neighborhood Business District to B -3, Highway and Arterial Business District? RECOMMENDATION The Planning and Zoning Commission, at their May 10, 2006 regular meeting, voted 6 -0 to recommend approval. BACKGROUND City Council approved the Vaughn Subdivision in January of 1995. Applicant contends that by the definition of the B -3 zone district the Zoning Ordinance should allow this property to be zoned B -3. The application implies that the City must have erred when it annexed the property into the City and zoned it B -1. FINANCIAL IMPACT None.
