AN ORDINANCE CHANGING ZONING RESTRICTIONS FROM R -2 AND A -1 TO R -2U
COVERING A PARCEL OF LAND COMMONLY KNOWN AS HERITAGE VILLAGE FILING NO. 4,
AND SETTLERS VILLAGE, FILINGS NO. 5 AND NO. 6
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The zoning restrictions covering the following described property be changed from R -2,
Single - Family Residential District and A -1, Agricultural One District, to R2 -U, Single - Family
Residential District, and upon passage of this ordinance, zoning restrictions affecting R2 -U, Single -
Family Residential District shall apply to said property:
Township 21 South, Range 65 West of the 6th P.M. in the County of Pueblo, State of
Colorado and being more particularly described as follows:
Considering the North line of Section 22, Township 21 South, Range 65 West of the
6th P.M. to bear N. 89 0 40'00" E. and all bearings contained herein being relative
thereto.
R -2 TO R -2U
Commencing at the Northwest corner of said Section 22; thence S. 00 0 00'39" E.,
along the West line of the NW Ya of said Section 22, a distance of 825.01 feet;
thence N. 89 0 40'00" E., a distance of 30.00 feet to the East right -of -way line of
Starlite Drive as presently located and the Southwest corner of Heritage Village,
Filing No. 3 A Special Area Plan according to the recorded plat thereof as filed for
record at Reception No. 1380579 in the Pueblo County records; thence N.
89 °40'00" E., along the South line of said Heritage Village, Filing No. 3 A Special
Area Plan and Heritage Village, Filing No. 2 A Special Area Plan according to the
recorded plat thereof as filed for record at Reception No. 1349658 in the Pueblo
County records, a distance of 1980.41 feet to the centerline of Hollywood Drive as
presently located in Settlers Village, Filing No. 2 according to the recorded plat

SECTION 2.
This ordinance shall become effective immediately upon final passage and approval.

HERITAGE VILLAGE FILING NO. 4, SETTLERS VILLAGE, FILINGS NO. 5 AND
NO. 6
ISSUE
Shall City Council approve a request to rezone the property from R -2, Single -
Family Residential District and A -1, Agricultural One District, to R -21-1, Single -
Family Residential District?
RECOMMENDATION
The Planning and Zoning Commission, at their March 8, 2006 regular meeting,
voted 5 -0 to recommend approval.
BACKGROUND
The Heritage Village Filing No. 4 and Settlers Village, Filing No. 5 and No. 6, is
generally located east of Starlight Drive and south of Farabaugh Lane.
On March 10, 2004, the Planning and Zoning Commission approved an
amendment updating the 1997 South Point Master Development Plan. Within
this section of the plan low to medium density single - family residential is
permitted. As proposed, this request will provide for three (3) single - family
residential subdivision filings to be developed under the recently adopted R -2U
zone district standards.
