HomeMy WebLinkAbout07442SUBSTITUTED COPY 02/24/2006 ORDINANCE NO. 7442 AN ORDINANCE ESTABLISHING A BUDGET FOR THE HISTORIC ARKANSAS RIVERWALK OF PUEBLO - PHASE III A -1 PROJECT IN THE AMOUNT OF $3,100,568, APPROPRIATING $3,003,568 FOR THE CONSTRUCTION OF SAID PROJECT, AND RATIFYING THE ACCEPTANCE, APPROVAL AND EXECUTION OF FINANCIAL ASSISTANCE AWARD NUMBER 05 -01 -04239 FROM U.S. DEPARTMENT OF COMMERCE, ECONOMIC DEVELOPMENT ADMINISTRATION FOR CONSTRUCTION OF PHASE III A -1 OF THE HISTORIC ARKANSAS RIVERWALK OF PUEBLO BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO. that: SECTION 1. The budget for Phase III A -1 of Capital Improvement Project No. PWHP07 in the amount of $3,100,568 is hereby established, of which $150,000 has been previously appropriated and expended pursuant to Ordinance No. 6844, $247,000 has been previously appropriated and expended pursuant to Ordinance No. 7047, and $100,000 has been previously appropriated and budgeted in the 2006 City of Pueblo Budget. SECTION 2. $3,003,568 is hereby appropriated and transferred from General Fund Reserves to Capital Improvement Project No. PWHP07 for the construction of Phase III A -1 of the project. SECTION 3. City Council finds and determines that funds for construction of the HARP Phase III A -1 project will be provided from the following sources: $1,000,000 Economic Development Administration (EDA) 900,000 Department of Local Affairs to the City 500,000 Great Outdoors Colorado to the City 650,568 HARP Foundation ($100,000 per Ordinance No. 6844) ($247,000 per Ordinance No. 7047) 50,000 Pueblo Urban Renewal Authority (per Ordinance No. 6844) $3,100,568' Total Cost ($20,000 for Environmental Mitigation Contingency and $3,080,568 for Construction of Phase III A -1) Total includes funds expended for schematic design ($150,000, Ordinance No 6844) and final design ($247,000, Ordinance No 7047) development for HARP Phase III A -1. SECTION 4. The acceptance, approval and execution of the Financial Assistance Award Number 05 -01- 04239 from the U.S. Department of Commerce, Economic Development Administration for construction of Phase III A -1 of the Historic Arkansas Riverwalk of Pueblo is hereby ratified and authorized nunc pro tunc to February 13, 2006. SECTION 5. This Ordinance shall become effective immediately upon final passage and approval. Approve the Ordinance. The electors, in 1995, approved a question relating to a Limited Tax General Obligation Bond for the financing of the Historic Arkansas Riverwalk Project. The scope of this project was envisioned in 1995 and depicted in the November 26, 1996, HARP Program Document, which was incorporated as a part of the HARP Intergovernmental Agreement as the Development Plan. The Program Document depicts the HARP extension between Grand Avenue and the Convention Center. To date the HARP Project has completed Phase I — Channel and Infrastructure Development and the Phase II (a, b & c) — Enhancements to the project. With the passage of the HARP Bond, the project included the extension from Grand Avenue to the Convention Center, which is the third phase of the project. With the completion of Phase II construction in early 2000, the City, the HARP Authority, the HARP Foundation, and the Urban Renewal Authority have been developing the design for the channel extension to the Convention Center, known as Gateway Park (Phase III). See attached plan depicting the final design. The City and the HARP Foundation have raised funds to begin constructing Phase III A -1, which is the first step in building Phase IIII. Phase III A -1 will including the preparation of the necessary construction drawings; subsurface infrastructure and utility improvements; channel extension and attached walkway and landscaping This ordinance will also ratify the acceptance, approval and execution of the Financial Assistance Award, Number 05- 01- 04239, from the U.S. Department of Commerce, Economic Development Administration for funds to construct Phase III A -1. FINANCIAL IMPACT Ordinance No. 6844 established Capital Improvement Project No. PWHP07 for the construction of the HARP Phase III project. This ordinance will budget $3,100,568 in funds for Phase III A -1 of which $3,080,568 will fund the design, engineering and construction and $20,000 will fund the environmental mitigation contingency. The Economic Development Administration requires that the City certify that all the match money is in place and committed to the project at the time the City approves and executes the financial assistance award. To meet this requirement, the City will appropriate an additional $3,003,568 from the City's general fund reserves. As funds from the above referenced sources are received, a like amount will be returned to the general fund. The total funds appropriated for the project with the passage of this Ordinance are $3,500,568, this includes $3,003,568 /general fund, $100,000 in half -cent sales tax interest/budgeted and appropriated in FY06, $150,000 /preliminary design, and $247,OOO1final design. The difference in appropriated funds of $3,500,568 and the $3,100,568 budgeted for construction of Phase III A -1 is $400,000. The Department of Local Affairs provides this additional $400,000 under our agreement to rescind Ordinance No. 7289. The City will transfer under separate Ordinance the $400,000 in general funds appropriated for the HARP project to the Pueblo- Bessemer Utilities. 4el xz AL �'i
