ORDINANCE NO. 7439
AN ORDINANCE VACATING UTILITY, DRAINAGE, AND
SIDEWALK EASEMENTS WITHIN LOTS 1 THROUGH 24,
BLOCK 5, REGENCY CREST SUBDIVISION, FILING NO. 7
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that:
SECTION 1.
The utility, drainage, and sidewalk easements within Lots 1 to 24, Block 5, Regency
Crest Subdivision, Filing No. 7 and more particularity described as follows:
All public utility, drainage, and sidewalk easements within Lots 1 to 24, Block 5,
Regency Crest Subdivision, Filing No. 7, County of Pueblo, State of Colorado, as
recorded at Reception No. 1622913 on June 3, 2005 of the Pueblo County
Records.
are hereby vacated.
SECTION 2.
This ordinance shall become effective immediately upon final passage and
approval.

ISSUE
Shall City Council approve the utility, drainage, and sidewalk easement vacations
within Lots 1 -24, Block 5, Regency Crest Subdivision, Filing No. 7?
RECOMMENDATION
The Planning and Zoning Commission, at their December 14, 2005, regular
meeting, voted 5 -0 to recommend approval.
BACKGROUND
On April 25, 2005, City Council approved the Regency Crest Subdivision, 7
Filing. The developer proposes to replat 24 single - family residential lots located
within Block 5, Regency Crest Subdivision, 7 Filing, into 22 lots as part of a
concurrent resubdivision request (S- 05 -14). This application will remove existing
easements to accommodate the resubdivision request. It is the recommendation
of the Subdivision Review Committee (SRC) memo dated November 16, 2005 that
the vacation be approved.

None.
