HomeMy WebLinkAbout07435ORDINANCE NO. 7435 AN ORDINANCE AMENDING CHAPTER 4 OF TITLE XVII OF THE PUEBLO MUNICIPAL CODE RELATING TO OFF - STREET PARKING REQUIREMENTS BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, THAT: (BRACKETS INDICATE MATTER BEING DELETED; UNDERSCORING INDICATES MATTER ADDED) SECTION 1 Section 43 of Chapter 4 of Title XVII of the Pueblo Municipal Code is hereby amended by the following: Sec. 17 -4-43. Off - street parking nonresidential. (a) Application. The off - street parking requirements herein contained shall apply only to buildings and uses newly constructed, moved, extended or enlarged, and shall not apply to buildings lawfully repaired or improved where no increase of floor area is made, except for restrooms [,] or elevators, as provided in this Section. The regulations in this Section shall apply to all parking spaces, lots, garages, buildings or portions thereof to be provided in meeting the requirements of this Section. The addition of an adjacent building, whether attached or detached, shall constitute an increase in floor space and shall be included in any calculation of area to meet the requirements of this Section. The City Traffic Engineer may grant a one -time exemption from the regulations in this Section for a building which is increased no more than [one hundred fifty (150)] two - hundred 2( 00) square feet of gross floor area for the [sole] purpose of providing either restroom facilities or an elevator. All required parking spaces shall be permanent in character and provided with a permanent driveway to a public way. The driveway and parking spaces shall be paved with asphalt, concrete, Portland cement concrete or pavers. SECTION 2 This ordinance shall become effective upon final passage and approval. PACHECO TITLE AN ORDINANCE AMENDING CHAPTER 4 OF TITLE XVII OF THE PUEBLO MUNICIPAL CODE RELATING TO OFF - STREET PARKING REQUIREMENTS. ISSUE Should the City Council amend Chapter 4 of Title XVII of the Pueblo Municipal Code relating to off - street parking requirements? RECOMMENDATION The Planning and Zoning Commission, at their regular meeting on December 14, 2005, voted 5 -0 to recommend approval. BACKGROUND Currently the off - street parking requirements offer a one -time exemption for the regulations in Section 17 -4 -43 for a building which is increased by no more than 150 square feet for the sole purpose of adding restroom facilities. The proposed ordinance revises Section 17-4- 43 by allowing the addition of either an elevator or restroom facilities which increases the square footage of the building by not more than 200 square feet to receive a one -time exemption from the off - street parking requirements.
