PACHECO TITLE AN ORDINANCE APPROVING THE VILLA'S AT PARK WEST, A SPECIAL AREA PLAN ISSUE Shall City Council approve a Special Area Plan on 23.076 acres to receive credit for the recreational amenities provided within the multi - family complex? RECOMMENDATION The Planning and Zoning Commission, at their October 12, 2005 regular meeting, voted 4 -0 to recommend approval. BACKGROUND Villa's at Park West a Special Area Plan is generally located on the north side of Pueblo, north of 29 Street and west of Spaulding Avenue. The proposed Special Area Plan for The Villas at Park West is a multi - family apartment complex built primarily in 2004. When this area was approved for development the property owner was required to pay cash in -lieu of a park dedication to serve this project. Per Section 12- 4- 7(e)(5) of the Pueblo Municipal Code a park dedication is not required when a special area plan is approved to provide recreational facilities for the residents. In this case, the applicant wishes to have this special area plan approved whereby the park dedication requirements may be satisfied by the existing clubhouse and pool, and the prior cash in -lieu payment returned.
