HomeMy WebLinkAbout07395ORDINANCE NO. 7395 AN ORDINANCE AMENDING SECTIONS 21 AND 22 OF CHAPTER 4 OF TITLE XVII OF THE PUEBLO MUNICIPAL CODE RELATING TO FENCES, WALLS, HEDGES AND VISIBILITY AT INTERSECTIONS, AND MAKING SAID SECTIONS CONSISTENT WITH CHAPTER 3 OF TITLE XV OF THE PUEBLO MUNICIPAL CODE RELATING TO TRAFFIC HAZARDS BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that (brackets indicate matter deleted, underscoring indicates matter added): SECTION 1. Section 21 of Chapter 4 of Title XVII is hereby amended to read as follows: Sec. 17 -4 -21. Visibility at intersections [in residential districts]. [On a corner lot in any residential district, nothing shall be erected, placed, planted or allowed to grow in such a manner as materially to impede vision between a height of two (2) and eight (8) feet above the centerline grades of the intersecting streets in the area bounded by the street lines of such corner lots and a line joining points along said street lines fifty (50) feet from the point of the intersection as measured at the curbline.] Nothing shall be erected, placed, planted or allowed to grow in such a manner as to constitute a sight obstruction at an intersection and a nuisance as defined in Chapter 3 of Title XV of this Code. SECTION 2. Section 22 of Chapter 4 of Title XVII is hereby amended to read as follows: Sec. 17 -4 -22. Fences, walls and hedges. Except as [required] prohibited in [Section 17 -4 -21] Chapter 3 of Title XV of this Code, fences, walls and hedges may be permitted in any required yard, or along the edge of any yards. SECTION 3. This Ordinance shall become effective immediately upon final passage and approval. RECOMMENDATION The Planning and Zoning Commission, at their December 4, 2004 regular meeting voted 5 -0 to recommend approval. The purpose of the Proposed Ordinance is to make the provisions in § §17 -4 -21 and 17 -4 -22, P.M.C. consistent with Ordinance No. 7206. Ordinance No. 7206 prohibits sight impairments at intersections and specifically defines what constitutes the clear sight triangle at an intersection. §15- 3 -1(a), P.M.C. Under this definition, the clear sight triangle is not a fixed area applicable to all intersections as is set forth in §17 -4 -21, P.M.C., but is a flexible area dependant upon the particular intersection and such factors as the design speeds of the intersecting roadway, type of traffic control used at the intersection, the direction of approaching traffic and the size of the intersection area. FINANCIAL IMPACT None.
