ORDINANCE NO. 7389
AN ORDINANCE VACATING ALL OF THE FIVE FOOT DRAINAGE EASMENT ALONG
THE SOUTHERLY LINE OF LOT 3, BLOCK 1, EXCEPT THE SOUTHERLY FIVE FEET;
AND ALL OF THE FIVE FOOT DRAINAGE EASMENT ALONG THE NORTHERLY LINE
OF LOT 4, BLOCK 1, EXCEPT THE SOUTHERLY FIVE FEET IN VENTANA FILING NO.
1 SUBDIVISION
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that:
SECTION 1.
Drainage easements located in Lots 3 and 4, Block 1, Ventana Filing No. 1
Subdivision more particularly described as follows:
All of the five foot drainage easement along the southerly line of Lot 3, Block 1, except
the southerly five feet; and all of the five foot drainage easement along the northerly line
of Lot 4, Block 1, except the southerly five feet in Ventana Filing No. 1 Subdivision
are hereby vacated.
SECTION 2.
This ordinance shall become effective immediately upon final passage and
approval.

SOUTHERLY FIVE FEET IN VENTANA FILING NO. 1 SUBDIVISION
ISSUE
Shall City Council approve the drainage easement vacations in Lots 3 and 4,
Block 1, Ventana Filing No. 1 Subdivision?
RECOMMENDATION
The Planning and Zoning Commission, at their September 14, 2005, regular
meeting, voted 6 -0 to recommend approval.
BACKGROUND
Applicant intends to consolidate two (2) lots into a single building site for a single -
family residence. A platted drainage easement exists in a location that will be the
center of the new building site. In order to build the residence as proposed the
drainage easement must be vacated. It is the recommendation of the Subdivision
Review Committee (SRC) memo dated August 24, 2005, that the vacation be
approved.
FINANCIAL IMPACT
None.
