AN ORDINANCE AUTHORIZING THE APPROPRIATION OF $35,000 FROM THE GENERAL
RESERVE FUND TO CAPITAL PROJECT CP0139 FOR THE CONTINUED LEGAL SERVICES OF
HOLLAND AND HART, LLP TO ASSIST AND ADVISE THE CITY OF PUEBLO IN WATER RIGHTS,
LITIGATION, AND RELATED ADMINISTRATIVE PROCEEDINGS FOR THE REMAINDER OF
FISCAL YEAR 2005
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
Holland and Hart, LLP is hereby authorized to continue advisement and assistance to the City
of Pueblo through fiscal year 2005 regarding water rights, related administrative proceedings, and
pending Recreational In Channel Diversion litigation.
SECTION 2.
Funds in the amount of $35,000 are hereby appropriated from the General Reserve Fund to
Capitol Project - CP0139.

FISCAL YEAR 2005
ISSUE
Currently there is $7,678.41 remaining of the $800,000 appropriated for the legal
fees of Holland and Hart, LLP, which is assisting and advising the City of Pueblo
concerning water rights issues and litigation matters. It has been determined that
an additional $35,000 will be needed to procure the continued services of
Holland and Hart, LLP through the end of fiscal year 2005. These additional
funds will be appropriated from the General Reserve Fund into Capital Project
( "In- Stream Water Rights ") - CP0139.
RECOMMENDATION
Approval of the Ordinance.
FINANCIAL IMPACT
An additional $35,000 cost will be incurred. Said funds will be appropriated from
the General Reserve Fund.
