HomeMy WebLinkAbout07382ORDINANCE NO. 7382 AN ORDINANCE REPEALING CHAPTER 11, TITLE IV, OF THE PUEBLO MUNICIPAL CODE RELATING TO ENERGY EFFICIENCY STANDARDS FOR NONRESIDENTIAL BUILDINGS BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO that: (Brackets indicate matter to be deleted; underscoring indicates matter to be added.) SECTION 1. CHAPTER 11 RESERVED [Energy Efficiency Standards for Nonresidential Buildings Sec. 4 -11 -1. The Colorado Model Energy Efficiency Construction and Renovation Standards for Nonresidential Buildings; adoption by reference. (a) The Colorado Model Energy Efficiency Construction and Renovation Standards for Nonresidential Buildings adopted November 1977, and published March 1978, by the State of Colorado, Office of State Planning and Budgeting, Board for Energy Efficient Nonresidential Building Standards, 1525 Sherman Street, Denver, Colorado 80203, as amended by this Chapter, is hereby adopted and enacted by reference and made a part hereof as if set out herein in full. (b) Copies of the Colorado Model Energy Efficiency Construction and Renovation Standards for Nonresidential Buildings are available in the Office of the Inspection Division of the Department of Public Works of the City for distribution and sale to the public at a price not to exceed the actual cost to the City plus a handling charge of twenty -five cents ($.25) per copy. (Ord. No. 4490, 6- 26 -78) Sec. 4 -11 -2. Purpose. The purpose and subject of the Colorado Model Energy Efficiency Construction and Renovation Standards for Nonresidential Buildings is to provide comprehensive provisions and standards regulating energy efficiency in the design, construction, renovation, erection, enlargement, alteration, repair, conversion, occupancy, equipment and maintenance of certain nonresidential buildings and structures for the purposes of protecting the public health, safety and general welfare. (Ord. No. 4490, 6- 26 -78) Sec. 4 -11 -3. Amendments The Colorado Model Energy Efficiency Construction and Renovation Standards for Nonresidential Buildings is hereby amended as follows: (1) Section 101.1 is deleted in its entirety. (2) Section 107.0 is deleted in its entirety. (3) A new Section 108.0 is added, to read: "108.0. Administrative and appeal procedures set forth in Sections 201, 202 and 204, and Chapter 3 of the Uniform Building Code, 1973 edition, shall be applicable and followed in the administration of this Code." (4) Section 302.1 is amended to read as follows: "Winter Design Dry -Bulb -1° F Summer Design Dry-Bulb 94° F Summer Design Wet -Bulb 67° F Degree Days Heating 5394 Degrees North Latitude 38 17" (5) Section 502.2(a), Table 5 -1, is amended by the addition of the following specific values: "Walls, 3 stores or less, heating, Uo not exceeding .29 Walls, 3 stories or less, Cooling, OTTV not exceeding 33 Walls, over 3 stories, Heating, Uo not exceeding .35 Walls, over 3 stories, Cooling, OTTV not exceeding 33 Roof /Ceiling, Heating or Cooling, Uo not exceeding .08 Floors over unheated spaces, Heating, Uo not exceeding .08 Slab on Grade, Heating, minimum R value 4.5 unheated, 6.6. heated Solar Factor, Cooling 126" (6) Section 701.0 is amended by the addition of the following: "SMACNA refers to Sheet Metal Air Conditioning Contractors National Association. "NESCA refers to National Environmental System Contractors Association. "NWMA refers to National Woodwork Manufacturing Association, Inc." (Ord. No. 4490, 6- 26 -78) Sec. 4 -11-4. Penalties. It shall be unlawful for any person to erect, construct, renovate, enlarge, alter, repair, improve, convert, equip, use, occupy or maintain any building or structure or cause or permit the same to be done contrary to or in violation of any of the provisions of the Colorado Model Energy Efficiency Construction and Renovation Standards for Nonresidential Buildings and this Chapter. Any person convicted of a violation of this Chapter or the Colorado Model Energy Efficiency Construction and Renovation Standards for Nonresidential Buildings shall be punished by imprisonment for not more than ninety (90) days, or by a fine of not more than three hundred dollars ($300.00) or by both such fine and imprisonment. ISSUE Should the proposed Ordinance be approved? RECOMMENDATION The proposed Ordinance should be approved. BACKGROUND Due to the adoption of the 2003 International Codes to include the 2003 International Energy Conservation Code, Chapter 11 must be deleted to prevent duplication of the Energy Code. FINANCIAL IMPACT None.
