HomeMy WebLinkAbout07381ORDINANCE NO. 7381 AN ORDINANCE AMENDING CHAPTER 4, TITLE IV, OF THE PUEBLO MUNICIPAL CODE RELATING TO THE UNIFORM PLUMBING CODE AND AMENDING CERTAIN PROVISIONS THEREOF BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO that: (Brackets indicate matter to be deleted; underscoring indicates matter to be added.) SECTION 1. Subsection (x) of Section 2 of Chapter 4, Title IV, of the Pueblo Municipal Code is amended and deleted as follows: (x) [Section 412.0 of the U.P.C. entitled "Floor Drains and Shower Stalls" is amended by the addition of a new subsection 412.2.4 to read as follows: "412.2.4 Within three (3) feet where a hot water heating appliance or any condensing equipment are located. The total number of water closets for females shall be at least equal to the total number of water closets and urinals required for males. This requirement shall not apply to Retail or Wholesale Stores. 15. For smaller type Public and Professional Offices such as banks, dental offices, law offices, real estate offices, architectural offices, engineering offices, and similar uses. A public area in these offices shall use the requirements for Retail or Wholesale Stores. 16. Where more than one (1) water closet or water closets and urinals are installed in a room they shall be separated by an approved partition wall. Urinals set next to each other or another fixture shall have an approved splash guard. 17. In each bathroom or toilet room, urinals shall not be substituted for more than 67% of the required water closets. SECTION 2. Nonliability. The adoption of this Ordinance shall not create any duty to any person, firm, corporation, or other entity with regard to the enforcement or nonenforcement of this Ordinance. No person, firm, corporation, or other entity shall have any private right of action, claim or civil liability remedy against the City of Pueblo or the Pueblo Regional Building Department, or their officers, employees or agents, for any damage arising out of or in any way connected with the adoption, enforcement, or nonenforcement of this Ordinance. Nothing in this Ordinance shall be construed to create any liability, or to waive any of the immunities, limitations on liability, or other provisions of the Governmental Immunity Act, Section 24 -10 -101, et seq., C.R.S., or to waive any immunities or limitations on liability otherwise available to the City of Pueblo or the Pueblo Regional Building Department, or their officers, employees or agents. SECTION 3. If any part, section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this Ordinance. SECTION 4. This Ordinance shall become effective immediately upon final passage and approval. RECOMMENDATION The proposed Ordinance should be approved. BACKGROUND Several large commercial projects were being presented to this Department for construction. Their standard plans for use nationwide showed far fewer rest room fixtures than our present code requires. We felt that a compromise on fixtures required was in order to facilitate the construction of these and possible future retail and office projects. FINANCIAL IMPACT None.
