ORDINANCE NO. 7375
AN ORDINANCE APPROVING THE SPECIAL AREA PLAN
IN MOSES BROTHERS SUBDIVISION
WHEREAS, a Special Area Plan for a portion of Moses Brothers Subdivision, has
been submitted to the Planning and Zoning Commission for approval pursuant to
Section 17 -4 -29 of the Pueblo Municipal Code, and
WHEREAS, the Planning and Zoning Commission after a public hearing found
and determined the objectives and requirements of said Section 17 -4 -29 can and will be
met, and
WHEREAS, the Planning and Zoning Commission has recommended the
approval of a Special Area Plan for a portion of Moses Brothers Subdivision without
conditions:
NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The Special Area Plan for a portion of Moses Brothers Subdivision being a
special area plan of land described as follows:
North 15' of Lot 13, and all of Lots 12 and 11, Block 2, Moses Brothers Subdivision in
the City of Pueblo, Colorado,
is hereby approved.
SECTION 2.
After considering the recommendation of the Planning and Zoning Commission,
the City Council finds and determines that the Special Area Plan includes and provides
for park and recreation facilities necessary to serve the proposed subdivision or
development and the future residents thereof.
SECTION 3.
This ordinance shall be approved upon final passage but shall not become
effective until the final plat for the special area plan hereby approved is recorded in the
office of the Pueblo County Clerk and Recorder.

ISSUE
Shall City Council approve a Special Area Plan for a portion of Moses Brothers
Subdivision?
RECOMMENDATION
The Planning and Zoning Commission, at their August 10, 2005 regular meeting,
voted 6 -0 to recommend approval.
BACKGROUND
The proposed Special Area Plan for Moses Brothers Subdivision, is a residential
project located at 1421 and 1423 Palmer Avenue. NeighborWorks of Pueblo has
acquired Lots 11 and 12 and 15 feet of Lot 13. Although the two proposed
building sites satisfy the minimum lot area requirements of the R -3 zone district
they fail to meet the minimum lot frontage requirement of 50 feet. Only through
the approval of a Special Area Plan may an exception to the minimum lot width
be permitted.
