HomeMy WebLinkAbout07346ORDINANCE NO. 7346 AN ORDINANCE AMENDING THE PUEBLO REGIONAL COMPREHENSIVE PLAN – 2002 AND ITS ASSOCIATED FUTURE LAND USE MAP RELATING TO LAND WEST OF LIME ROAD AND SOUTHEAST OF THE INTERSECTION OF INTERSTATE 25 AND PUEBLO BOULEVARD, INCLUDING THE EXISTING PROPERTY OF THE PUBLIC SERVICE COMPANY OF COLORADO, CHANGING THE FUTURE LAND USE DESIGNATION OF SAID LAND FROM RURAL / RANCH AND SPECIAL DEVELOPMENT AREA TO EMPLOYMENT CENTER–INDUSTRY. WHEREAS, pursuant to Section 12 -5 of the City Charter, the City Council after recommendation by the Planning and Zoning Commission adopted the Pueblo Regional Comprehensive Development Plan -2002 sometimes known as Pueblo's Comprehensive Plan as the comprehensive master plan for the physical development of the City, and WHEREAS, Pueblo Regional Comprehensive Development Plan -2002 includes a Future Land Use Map as a guide for making decisions concerning the appropriateness of planned development with respect to land use, and WHEREAS, the Future Land Use Map shows the area generally west of Lime Road and east of the intersection of Interstate Highway 25 and Pueblo Boulevard, including the existing Public Service Company of Colorado Corporation properties, as Rural – Ranch and Special Development Area, and WHEREAS, the descriptions of Rural – Ranch and Special Development Area do not accurately describe the existing or future uses thereof, and WHEREAS, existing uses of the land identified as Rural – Ranch include electric power generation facilities, a use by right only in an 1 -3 zone district and incompatible with the description of Rural – Ranch and Special Development Area in the Pueblo Regional Comprehensive Development Plan -2002, and WHEREAS, the Planning and Zoning Commission pursuant to Section 12 -5 of the City Charter recommends that the future land use designation for said lands be amended to Employment Center – Industry, and that the definition of Employment Center – Industry in the Pueblo Regional Development Plan be amended to specifically include "electric power generation facilities, to be consistent with existing and future uses for the land, and WHEREAS, the City Council does hereby find and determine that such an amendment would be in furtherance of and consistent with Pueblo Regional Comprehensive Development Plan. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO. that: SECTION 1. Sentence three of the definition of "Employment Center – Industry" on page 49 of the Pueblo Regional Development Plan is hereby amended to read: "This land use classification is also used to describe wastewater treatment and electric power generation facilities." SECTION 2. The future land use designation of lands west of Lime Road and east of the intersection of Interstate 25 and Pueblo Boulevard, depicted in Attachment 1, is hereby amended to: Employment Center — Industry in the Pueblo Regional Comprehensive Development Plan - 2002. SECTION 3. The Pueblo Regional Comprehensive Development Plan -2002 heretofore adopted and approved by the City Council together with the modification thereto set forth in Section 1 hereof are advisory only and shall apply to all land located within the jurisdictional boundaries of the City. SECTION 4. This ordinance shall become effective upon final passage and approval. ISSUE Shall City Council approve amend the Pueblo Regional Comprehensive Plan as specified. RECOMMENDATION Approval of Ordinance The Pueblo Regional Comprehensive Development Plan currently describes future land use for the existing and proposed expansion areas of the Comanche Power Plant as "rural - ranch ". The Plan and City Council's direction clearly anticipated continued operation of the electric power generating facility, and this future land use designation appears to have been an error in the plan's future land use map. The present ordinance corrects the error. To further clarify the intent of facilities, this future land use is "Employment Center — Industry". FINANCIAL IMPACT the plan to accommodate electric power generation added to the textual description of the future land use No financial impact.
