HomeMy WebLinkAbout07342ORDINANCE NO. 7342 AN ORDINANCE CHANGING ZONING RESTRICTIONS FROM R -6 TO B -3 COVERING A PARCEL OF LAND COMMONLY KNOWN AS 2001 NORTH HUDSON AVENUE BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The zoning restrictions covering the following described property be changed from R -6, Multiple - Residential and Commercial Business District to B -3, Highway and Arterial Business District, and upon passage of this ordinance, zoning restrictions affecting B -3, Highway and Arterial Business District shall apply to said property: LOTS 2 AND 3, RAMADA INN SUBDIVISION, 2ND FILING, and more commonly known as: 2001 NORTH HUDSON AVENUE. SECTION 2. This ordinance is approved upon the following conditions: 1). Before any building permits for new construction are issued the conditions of approval for Zoning Board of Appeals Case No. ZBA- 20- 1972(a) -2004 and ZBA- 20- 1972(b)- 2005 must be satisfied; 2). If the applicant cannot secure a building permit in conformance with Condition #1 above within 24 months or the expiration date of Zoning Board of Appeals Case No. ZBA- 20- 1972(b) -2005, whichever is sooner, City Council authorizes the Planning and Zoning Commission to initiate a rezoning of the subject properties back to a R -6, Multiple - Residential and Commercial District designation, and to vacate the Ramada Inn Subdivision Second Filing subdivision plat; and 3). The plat of Ramada Inn Subdivision, 2 nd Filing is approved by Ordinance. If the above conditions are not completed within a reasonable period not to exceed one year and one additional renewal of one year from the effective date of this Ordinance, or prior to the issuance of a business license for the property, whichever occurs first, the Planning and Zoning Commission shall institute proceedings to rezone the property to R -6, Multiple - Residential and Commercial District. SECTION 3. This ordinance shall become effective immediately upon final passage and approval. RECOMMENDATION The Planning and Zoning Commission, at their April 13, 2005 regular meeting, voted 4 -0 -1 (Johnson abstaining) to recommend approval of the rezoning. BACKGROUND The applicant requests rezoning for the subject property to provide commercial development to the southwest corner of U.S. Highway 50 and Hudson Avenue. No opposition to this application was presented and the Planning and Zoning Commission recommends approval upon the following conditions: 1). Before any building permits for new construction are issued the conditions of approval for Zoning Board of Appeals Case No. ZBA- 20- 1972(a) -2004 and ZBA- 20- 1972(b) -2005 must be satisfied; 2).
