HomeMy WebLinkAbout07336ORDINANCE NO. 7336 AN ORDINANCE AMENDING SECTION 8(a) OF CHAPTER 1 OF TITLE XV BY THE ADDITION OF SUBSECTION 7.5 RELATING TO THE MODEL TRAFFIC CODE, PROHIBITING THE OPENING OF VEHICLE DOORS IN AN UNSAFE MANNER AND PROVIDING PENALTIES FOR VIOLATION THEREOF BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: (Brackets indicate matter deleted, underscoring indicates matter added.) SECTION 1. Section 8(a) of Chapter 1 of Title XV is amended by the addition of the following new subsection: L2 1207. Opening and Closing Vehicle doors. No person shall open the door of a motor vehicle on the side available to moving traffic unless and until it is reasonably safe to do so and can be done without interfering with the movement of other traffic; nor shall any person leave a door open on the side of a vehicle available to moving traffic for a period of time longer than necessary to load or unload passengers. No person shall open the door of a motor vehicle that is located on private property used by the general public for parking purposes unless and until such action can be done safely and without interfering with movement or passage of another vehicle. SECTION 2. This Ordinance shall become effective upon final passage and approval. RECOMMENDATION The City Council should pass and approve the proposed Ordinance BACKGROUND Concern has arisen as to whether the Model Traffic Code's prohibition against unsafe opening of vehicle doors extends to vehicles that are located on private property used by the general public for parking purposes. The proposed Ordinance clarifies that such conduct is prohibited and a violation of the Model Traffic Code. FINANCIAL IMPACT None
