ORDINANCE NO. 7326
AN ORDINANCE APPROVING THE WEST VALLEY
ESTATES SUBDIVISION, A SPECIAL AREA PLAN,
FOURTH AMENDED
WHEREAS, The West Valley Estates Subdivision, A Special Area Plan, Fourth
Amended has been submitted to the Planning and Zoning Commission for approval
pursuant to Section 17 -4 -29 of the Pueblo Municipal Code, and
WHEREAS, the Planning and Zoning Commission after a public hearing found
and determined the objectives and requirements of said Section 17 -4 -29 can and will be
met, and
WHEREAS, the Planning and Zoning Commission has recommended the
approval of The West Valley Estates Subdivision, A Special Area Plan, Fourth Amended
without conditions:
NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The West Valley Estates Subdivision, A Special Area Plan, Fourth Amended
being a special area plan of land described as follows:
Lot 75, West Valley Estates Subdivision, a Special Area Plan, County of Pueblo, State
of Colorado, according to that Special Warranty Deed filed for record August 10, 2004
at Reception No. 1579680.
And
Lot 76, West Valley Estates Subdivision, a Special Area Plan, County of Pueblo, State
of Colorado, according to that Warranty Deed filed for record September 14, 2004 at
Reception No. 1584611,
is hereby approved.

After considering the recommendation of the Planning and Zoning Commission,
the City Council finds and determines that the Special Area Plan includes and provides
for park and recreation facilities necessary to serve the proposed subdivision or
development and the future residents thereof.
SECTION 3.
This ordinance shall be approved upon final passage but shall not become
effective until (a) the Ordinance approving the Plat of The West Valley Estates becomes
effective pursuant to Section 4 of that Ordinance, and (b) the final plat for the special
area plan hereby approved is recorded in the office of the Pueblo County Clerk and

ISSUE
Shall City Council approve an amendment to West Valley Estates Subdivision, A
Special Area Plan, Fourth Amended?
RECOMMENDATION
The Planning and Zoning Commission, at their May 11, 2005 regular meeting,
voted 6 -0 to recommend approval.
BACKGROUND
West Valley Estates Subdivision, A Special Area Plan, Fourth Amended is more
commonly known as 2307 and 2309 Sunburst Court, the residential area located
off Pueblo Boulevard to W. 24 Street to Newport Avenue. The proposed
amendment creates a single parcel from Lots 75 and 76 by amending Case No.
SAP- 98 -07.

None.
